{"data":{"id":"us-ky/krs-61.590","jurisdiction":"us-ky","citation":"KRS 61.590","heading":"Filing of Notification of Retirement and  Estimated  Retirement","body":"Allowance forms -- Selection of payment option -- Effective date.\n(1) (a) A member  or beneficiary eligible to receive retirement benefits under any\nof the provisions of KRS  61.510 to 61.705, 78.510 to 78.852, and 16.510\nto 16.652 shall have on file at the retirement office on the form prescribed\nby the board, a correctly completed notification of retirement, giving his or\nher name, address, Social Security number or Kentucky Public Pensions\nAuthority member  identification number, last day of employment, and\nother information the Authority may require. The form entitled \"Notification\nof Retirement\" shall not be filed more than six (6) months before the\nmember's effective retirement date.\n(b) A  member  eligible to receive retirement benefits under any of the\nprovisions of KRS  61.510 to 61.705, 78.510 to 78.852, and 16.510 to\n16.652 shall certify in writing on the \"Notification of Retirement\" form or\nanother form prescribed by the board that no prearranged agreement\nexisted prior to the member's retirement between the member  and any\nparticipating agency  in the systems administered by the Kentucky\nRetirement Systems or any participating agency in the County Employees\nRetirement System for the member  to return to employment with the\nparticipating agency. No retirement benefits shall be paid to the member\nuntil the member  completes the certification required by this paragraph.\n(2) After receipt of the correctly completed  form  entitled \"Notification of\nRetirement,\" the Authority shall cause to be prepared an estimate of the\namounts  the member  or beneficiary may expect to receive under the various\nplans available to the member  or beneficiary. This information shall be\nrecorded on a form entitled \"Estimated Retirement Allowance\" and forwarded\nto the member  or beneficiary.\n(3) The  member  or beneficiary shall file at the retirement office the form entitled\n\"Estimated Retirement Allowance\" after he or she has checked one (1)\npayment  option of his or her choice, signed the document, and had his or her\nsignature witnessed. A member  shall not have the right to select a different\npayment  option on or after the first day of the month in which the member\nreceives his or her first retirement allowance or after the effective date of a\ndeferred retirement option as provided by subsection (6) of this section, except\nas provided by KRS  61.542(5). A beneficiary shall not have the right to select a\ndifferent payment option after the effective date of the beneficiary's retirement\nallowance as provided in subsection (7) of this section.\n(4) A member  or beneficiary choosing a monthly payment option shall have on file\nat the retirement office his or her birth certificate or other acceptable evidence\nof date of birth. If a survivorship option is chosen, proof of dates of birth of the\nbeneficiary and member  shall be on file at the retirement office.\n(5) (a) The effective date of normal retirement shall be the first month following\nthe month in which employment from all employers participating in any of\nthe systems administered by Kentucky Retirement Systems  and  all\nemployers participating in the County Employees Retirement System was\nterminated.\n(b) The effective date of disability retirement shall be the first month following\nthe month in which the member's last day of paid employment in a regular\nfull-time position occurred, provided the member  files the form entitled\n\"Estimated Retirement Allowance\" no later than six (6) months following\nthe date the notification of approval for disability retirement benefits is\nsent by United States first-class mail to the member's last address on file\nin the retirement office, by electronic mail to the member's last electronic\nmail address on file in the retirement office, or by other electronic means.\nIf the member  fails to file the form entitled \"Estimated Retirement\nAllowance\" within six (6) months of the date the notification of approval for\ndisability retirement benefits is sent, then the member's form entitled\n\"Notification of Retirement\" shall be void. The member  shall be required\nto submit a new form entitled \"Notification of Retirement\" to apply for\ndisability retirement and reestablish eligibility for disability retirement\nbenefits.\n(c) The effective date of early retirement shall be the first month following the\nmonth  a correctly completed form entitled \"Notification of Retirement\" is\nfiled at the retirement office or a future month designated by the member,\nif employment  from all employers participating in any of the systems\nadministered by  Kentucky  Retirement Systems  and  all employers\nparticipating in the County Employees  Retirement System  has been\nterminated and  if the member  files the form entitled \"Estimated\nRetirement Allowance\" no later than six (6) months following termination.\nIf the member  fails to file the form entitled \"Estimated Retirement\nAllowance\" within six (6) months following the effective retirement date of\nthe member, then the member's form entitled \"Notification of Retirement\"\nshall be void and the member  shall be required to submit a new form\nentitled \"Notification of Retirement\" to apply for early retirement.\n(6) The  effective date of a deferred retirement option as provided under KRS\n16.576(5) shall be the month  following age sixty-five (65), or the month\nfollowing written notification from the member  that he or she wishes to begin\nreceiving retirement payments. In the event of the death of a member  who has\ndeferred his or her retirement allowance, the effective date of retirement shall\nbe the month following the member's death.\n(7) Notwithstanding the provisions of KRS 16.578 or 61.640, the effective date of a\nbeneficiary's retirement allowance under normal, early, or disability retirement\nshall be as prescribed in subsection (5) or (6) of this section if the member  dies\nbefore the first day of the month in which the member  would have received his\nor her first retirement allowance and his or her beneficiary becomes eligible for\npayments under KRS 16.578 or 61.640.","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52261","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:15Z","sha256":"637db258b46703c29b87f27f92a7d69b2f4652eb33442d583e162f29fa81111d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.585","next":"us-ky/krs-61.592"},"notice":"GroundRules: Original legal text.
