{"data":{"id":"us-ky/krs-61.610","jurisdiction":"us-ky","citation":"KRS 61.610","heading":"Employment  and medical review after disability retirement -- Filing of","body":"review forms -- Duty of system to assist in obtaining records -- Disability\nfraud investigator.\n(1) Once  each year following the retirement of a person on a disability retirement\nallowance, except for persons who become  totally and permanently disabled\nas a direct result of an act in line of duty as defined in KRS  16.505 or become\ndisabled as a result of a duty-related injury as defined in KRS  61.621 in which\ncase shall be once every three (3) years following retirement, or less frequently\nas determined by the board's medical examiner but not less than once every\nfive (5) years, the system may require the person, prior to his or her normal\nretirement date, to undergo an employment and medical staff review and, if\nnecessary, be required to file at the retirement office on the review form\nprescribed by the board current employment information and current medical\ninformation for the bodily injury, mental illness, or disease for which he or she\nreceives a disability retirement allowance. The person shall have one hundred\neighty (180) days from the day the system sent the review form by United\nStates first-class mail to the person's last address on file in the retirement\noffice, by electronic mail to the person's last electronic mail address on file in\nthe retirement office, or by other electronic means, to file at the retirement\noffice the review form and the current employment and medical information.\nThe person shall certify to the retirement office that the review form, including\ncurrent employment and medical information, is ready to be evaluated by the\nmedical examiner in accordance with KRS 61.615.\n(2) If, after good faith efforts, the person informs the system that he or she has\nbeen unable to obtain the employment or medical information, the system shall\nassist the person in obtaining the records and may use the authority granted\npursuant to KRS 61.685(1) to obtain the records.\n(3) If the person fails or refuses to file at the retirement office the review form,\nincluding the current employment and medical information, his or her retirement\nallowance shall be discontinued or reduced on the first day of the month\nfollowing the expiration of the one hundred eighty (180) days from the day the\nsystem sent the review form by United States first-class mail to the person's\nlast address on file in the retirement office, by electronic mail to the person's\nlast electronic mail address on file in the retirement office, or by other electronic\nmeans.  The Authority shall send notice of the discontinuance or reduction of\nthe disability retirement allowance by United States first-class mail to the\nperson's last address on file in the retirement office, by electronic mail to the\nperson's last electronic mail address on file in the retirement office, or by other\nelectronic means. If the person's benefits are discontinued or reduced under\nthis section, his or her rights to further disability retirement allowances shall\ncease, except as provided by KRS 61.615.\n(4) The Kentucky Public Pensions Authority shall hire or contract for the services\nof one (1) or more investigators to investigate potential fraud involving disability\nbenefits with the system. The investigators shall evaluate potential cases of\ndisability fraud and conduct spot audits for potential fraud as determined by the\nsystem  in cases involving members  who  become  totally and permanently\ndisabled as a direct result of an act in line of duty as defined in KRS  16.505 or\nbecome  disabled as a result of a duty-related injury as defined in KRS 61.621.","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52262","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:15Z","sha256":"9d2bc12cb58cfac08c62228d3d31b588007425d571e479c94bc69009af8309da","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.607","next":"us-ky/krs-61.615"},"notice":"GroundRules: Original legal text.
