{"data":{"id":"us-ky/krs-61.797","jurisdiction":"us-ky","citation":"KRS 61.797","heading":"Civil action for violation -- Damages.","body":"(1) A person alleging a violation of KRS 61.791 to 61.799 may bring a civil action for\nappropriate injunctive relief, damages, or both. Damages awarded under this section\nmay include one (1) of the following, as appropriate:\n(a) A sum of money that reflects th e actual damages caused by each violation of\nKRS 61.791 to 61.799;\n(b) A sum of money not less than two thousand five hundred dollars ($2,500) to\ncompensate for injury or loss caused by each violation of KRS 61.791 to\n61.799; or\n(c) For an intentional violation, a sum of money not to exceed three (3) times the\nsum described in paragraph (b) of this subsection.\n(2) A court, in rendering a judgment in an action brought under KRS 61.791 to 61.799,\nmay award all or a portion of the costs of litigation, includin g reasonable attorney\nfees and witness fees, to the complainant in the action if the court determines that\nthe award is appropriate.\n(3) A person who knowingly violates KRS 61.791 to 61.799 is guilty of a Class B\nmisdemeanor under KRS 532.020(3), and may b e subject to a fine of not more than\none thousand dollars ($1,000).","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54011","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:16Z","sha256":"798872b419e2523a07b705acb1c60713085140a294ef4c6f2f6e2d8c28ccc311","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.795","next":"us-ky/krs-61.799"},"notice":"GroundRules: Original legal text.
