{"data":{"id":"us-ky/krs-61.7991","jurisdiction":"us-ky","citation":"KRS 61.7991","heading":"Definitions -- Written request -- Prohibition of disclosure of identifiable","body":"information of judicial officers and immediate family -- Civil action.\n(1) As used in this section:\n(a) \"Covered person\" means a judicial officer or an immediate fami ly member of\na judicial officer;\n(b) \"Disclose\" means to post, display, publish, or otherwise make publicly\navailable;\n(c) \"Immediate family member\" means:\n1. A spouse, child, parent, or person under the familial custody or care of a\njudicial officer; or\n2. Any other familial relative who resides in the same household as the\njudicial officer;\n(d) \"Judicial officer\" means any active or senior judge and includes a:\n1. Justice of the United States or a judge of the United States as those\nterms are defined in 28 U.S.C. sec. 451;\n2. Bankruptcy judge appointed under 28 U.S.C. sec. 152 or recalled\npursuant to 28 U.S.C. sec. 375;\n3. United States magistrate judge appointed under 28 U.S.C. sec. 631 or\nrecalled pursuant to 28 U.S.C. sec. 375;\n4. Judge confirmed by the United States Senate and empowered by statute\nin any commonwealth, territory, or possession to perform the duties of a\nfederal judge;\n5. Judge of the United States Court of Federal Claims appointed under 28\nU.S.C. sec. 171; and\n6. Justice, judge, trial commissioner, or domestic relations commissioner\nof the Kentucky Court of Justice;\n(e) \"Personally identifiable information \" means data that can identify a covered\nperson and includes:\n1. Date of birth;\n2. Biometric, health, or medical data, or insurance information;\n3. Residence addresses of the covered person;\n4. Home or cellular telephone numbers;\n5. Personal email addresses;\n6. Identities of the children of a judicial officer and names and locations of\nschools and daycare facilities they attend;\n7. Social Security number; and\n8. The name of an immediate family member's employer; and\n(f) \"Written request\" means a notice sign ed by a covered person requesting a\ngovernment agency refrain from posting or displaying publicly available\ncontent that includes the personally identifiable information of the covered\nperson.\n(2) (a) A government agency shall not disclose the personally i dentifiable\ninformation of any covered person if the covered person has made a written\nrequest to the government agency that this personally identifiable information\nnot be disclosed.\n(b) Upon receipt of the written request, personally identifiable informa tion shall\nbe removed from publicly available content within seventy-two (72) hours.\n(c) A request under this subsection may be made on behalf of a minor who is a\ncovered person by a parent or guardian of the minor.\n(3) After the government agency has remo ved the personally identifiable information\nfrom publicly available content, the government agency shall not publicly post or\notherwise release the information unless the covered person voluntarily publishes\nthe information on the internet after June 27, 2025.\n(4) A covered person may bring a civil action seeking injunctive or declaratory relief to\nenforce this section in any court of competent jurisdiction.","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56515","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:16Z","sha256":"e6cf28764e5a88e90741f264da772dca56696a980075f945fbbcc21a4564ec6d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.799","next":"us-ky/krs-61.800"},"notice":"GroundRules: Original legal text.
