{"data":{"id":"us-ky/krs-61.8746","jurisdiction":"us-ky","citation":"KRS 61.8746","heading":"Commercial use of booking photographs or official inmate photographs","body":"prohibited -- Conditions -- Right of action -- Damages.\n(1) A person shall not utilize a booking photograph or a photograph of an inmate taken\npursuant to KRS 196.099 originally obtained from a public agency for a commercial\npurpose if:\n(a) The photograph will be placed in a publication or posted on a Web site; and\n(b) Removal of the photograph from the publication or Web site requires the\npayment of a fee or other consideration.\n(2) Any person who has requested the removal of a booking photograph or photo taken\npursuant to KRS 196.099 of himself or herself:\n(a) Which was subsequently placed in a publication or posted on a Web site; and\n(b) Whose removal requires the payment of a fee or other consideration;\nshall have a right of action in Circuit Court by injunction or other appropriate order\nand may also recover costs and reasonable attorney's fees.\n(3) At the court's discretion, any person found to have violated this section in an action\nbrought under subsection (2) of this section, may be liable for damages for each\nseparate violation, in an amount not less than:\n(a) One hundred ($100) dollars a day for the first thirty (30) days;\n(b) Two hundred and fifty ($250) dollars a day for the subsequent thirty (30) days;\nand\n(c) Five hundred ($500) dollars a day for each day thereafter.\nIf a violation is continued for more than one (1) day, each day upon which the\nviolation occurs or is continued shall be considered and constitute a separa te\nviolation.","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45230","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:16Z","sha256":"5b663bd4bc8f5f76dd62cb54b8de2d9102fbf26407f83b7a67032d7b4ce55558","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.8745","next":"us-ky/krs-61.876"},"notice":"GroundRules: Original legal text.
