{"data":{"id":"us-ky/krs-61.906","jurisdiction":"us-ky","citation":"KRS 61.906","heading":"Requirements for appointment.","body":"In order to qualify for a commission as a special law enforcement officer under KRS\n61.900 to 61.930, an individual must present satisfactory evidence of compliance\nwith the following conditions and requirements:\n(1) No person shall be eligible for a commission who:\n(a) Has  been dishonorably discharged from the Armed Forces of the United\nStates;\n(b) Has  been convicted in any jurisdiction of any felony or of any crime\ninvolving moral turpitude for which he or she has not received a full\npardon;\n(c) Has  been convicted of any other offense or offenses more than five (5)\ntimes within the previous three (3) years;\n(d) Has  by any court of competent jurisdiction been  declared mentally\ndisabled by reason of an intellectual disability or disease and has not\nbeen restored; or\n(e) Suffers from habitual drunkenness  or from narcotics addiction or\ndependence,  or from any  physical defect or deficiency which the\nsecretary determines to materially impair the applicant's ability to perform\nthe duties of a special law enforcement officer.\n(2) Every person to be eligible for a commission shall:\n(a) Have reached his or her twenty-first birthday;\n(b) Provide, on forms supplied by the secretary, such information pertaining\nto himself as may  reasonably be requested thereon, including, but not\nlimited to his:  name; age; date of birth; current address and employment;\nprior addresses and employment for the past ten (10) years; aliases, if\nany;  arrest and  conviction record, if any; Social Security number;\nfingerprints; photographs; and general physical description. The accuracy\nof such information shall be attested by the applicant and his or her\nattestation shall be notarized by one authorized to administer oaths;\n(c) Be of good moral character;\n(d) Provide references from two (2) reputable individuals who are not related\nto him or her and who have known him or her well for a period of not less\nthan three (3) years, attesting to his or her good character;\n(e) Pay the fees provided in KRS 61.908; and\n(f) Provide evidence satisfactory to the secretary that he or she meets the\nfollowing requirements:\n1. Is a graduate of an accredited high school or of an equivalent\ntechnical or vocational training or education program satisfactory to\nthe  secretary; or holds a  High School Equivalency Diploma;\nprovided, however, that all special local peace officers formally\ncommissioned under KRS  61.360 and with unexpired commissions\non  December  31, 1976, shall be  deemed  to have  met  the\nrequirements of this subsection;\n2. Has  successfully completed not fewer than eighty (80) hours of\ntraining in a  program  approved  by  the council and  dealing\ncomprehensively with the subjects of criminal law and the law of\narrest, search and seizure; or has been employed as a full-time\nsworn public peace officer for a period of not less than one (1) year\nwithin the past five (5) years, and has never been discharged for\ncause  from employment as a sworn public peace officer; or has\nbeen  employed  in a full-time capacity as a military policeman\nengaged  in law enforcement for the United States Armed Forces for\na period of not less than one (1) year within the past five (5) years;\nor  has  successfully completed  a  written, oral and  practical\nexamination approved by the council and dealing comprehensively\nwith the subject matter of criminal law and the law of arrest, search\nand seizure; and\n3. Demonstrates, in written and practical examinations approved by\nthe council, knowledge of and proficiency in firearms safety, range\nfiring, the moral and legal aspects of firearms use, and first aid.\nProvided, however, that all special local peace officers formally\ncommissioned under KRS  61.360 and with unexpired commissions\non  December  31, 1976, shall be  deemed  to have  met  the\nrequirements of these subsections.","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48564","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:16Z","sha256":"74a9c01667db3dd34f19078bf538e87341a77a19e5343b735a149043cde4b899","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.904","next":"us-ky/krs-61.908"},"notice":"GroundRules: Original legal text.
