{"data":{"id":"us-ky/krs-610.012","jurisdiction":"us-ky","citation":"KRS 610.012","heading":"Exclusive jurisdiction of District Court or family division of Circuit Court","body":"concerning temporary detention of suspected runaway.\n(1) The District Court or the family division of the Circuit Court shall have exclusive\njurisdiction of proceedings under this section.\n(2) Proceedings to temporarily detain a child suspected of being a runaway by means of\nan emergency protective custody order, pending further appropriate court action,\nshall be initiated by filing a complaint with the court-designated worker.\n(3) Notwithstanding any other provision of law to the contrary, a child who is suspected\nof being a runaway may be detained in a nonsecure facility for a period of time not\nto exceed seventy -two (72) hours, exclusive of weekends and holidays, or, if th e\ncourt makes a finding on the record that no less restrictive alternative is available, in\na secure juvenile detention facility for a period of time not to exceed twenty -four\n(24) hours, exclusive of weekends and holidays, pursuant to an ex parte emergenc y\nprotective order pending a court hearing to determine whether to return the child to\nhis or her custodian or give custody of the child to the cabinet.\n(4) If, at the hearing held as provided for in subsection (3) of this section, the child is\nnot release d, the court shall issue an emergency custody order pursuant to KRS\nChapter 620 and place the child with the cabinet and the cabinet shall file a\ndependency, neglect, or abuse action.\n(5) All hearings subsequent to the issuance of an emergency custody orde r shall be in\naccordance with KRS Chapter 620.\n(6) If the child is released, except to the cabinet pursuant to an emergency custody\norder, the court-designated worker shall initiate a status offense case.\n(7) The provisions of this section shall not apply to a child coming under the purview\nof KRS Chapter 615.","path":["KRS Chapter 610"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43965","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:07Z","sha256":"f7ac59d7e114941bf08bf60596823b1d4210ce89143ed5af73b5ff022b79bb9c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-610.010","next":"us-ky/krs-610.015"},"notice":"GroundRules: Original legal text.
