{"data":{"id":"us-ky/krs-610.120","jurisdiction":"us-ky","citation":"KRS 610.120","heading":"Review or termination of disposition orders.","body":"(1) Except as otherwise provided by KRS Chapters 605 and 635, an order of\ncommitment or an order of supervision or probation made by the court in the case of\na child may be terminated at any time prior to expiration on the court's own\ninitiative or on motion by:\n(a) A child who is affected by an order of juvenile session of District Court;\n(b) The family, custodian, guardian, or legal representative of such a child;\n(c) The Department of Juvenile Justice or the cabinet;\n(d) The county attorney of the county in which the committing court presides; or\n(e) Any other person having an interest in the welfare of the child.\n(2) Grounds for such action may include but are not limited to allegations that there has\nbeen a substantial change of material circumstances, ther e exists new evidence\naffecting the disposition of the child, the child is no longer in need of commitment,\nprobation, or placement, the child has not responded to or benefited from treatment\nor the child has not received adequate and proper treatment, the  original\nproceedings were not conducted in the manner required by law or the public interest\nrequires termination of the order. Upon review of the child's case, the Department\nof Juvenile Justice, the cabinet, any agency, facility, or individual responsib le for\nthe supervision, care, or treatment of the child shall divulge and communicate such\ninformation regarding the child as the court may require.\n(3) Except as otherwise provided by KRS Chapter 640 relating to youthful offenders,\nand KRS 610.110, 620.14 0, 635.060, 635.090, 635.515, or 645.140, relating to\nextending commitment beyond the age of eighteen (18), an order of commitment,\ntemporary custody, or an order of supervision or probation made by the court in the\ncase of a child shall be terminated when  the child attains the age of eighteen (18)\nunless otherwise provided in law. At least fourteen (14) days prior to the\ntermination of an order of commitment, the Department of Juvenile Justice or the\ncabinet shall prepare a summary of the information concerning the child and submit\nit with written notification to the committing court that a child's commitment is due\nto expire.","path":["KRS Chapter 610"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43969","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:07Z","sha256":"554e2a57c0c090037995a1bc43958ed8787dc2220d84260a5ea8bd3462edcd7d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-610.115","next":"us-ky/krs-610.125"},"notice":"GroundRules: Original legal text.
