{"data":{"id":"us-ky/krs-610.190","jurisdiction":"us-ky","citation":"KRS 610.190","heading":"Arrest laws applicable to child taken into custody -- Applicability of bail","body":"laws -- Protective custody by peace officer -- Custody by person other than\npeace officer.\n(1) The law relating to the persons by whom and the circumstances under which a\nperson may be arrested for a public offense shall be applicable to children, but the\ntaking of a child into custody under such law shall not be termed an arrest until the\ncourt has made the decision to try the child in Circuit or District Court as an adult.\nThe law relating to bail shall not be applicable to children detained in accordance\nwith this chapter unless the child is subject to being tried in Circuit or District Court\nas an adult.\n(2) A peace officer may take a child into protective custody if the o fficer suspects the\nchild to be a runaway. A child taken into protective custody under this subsection\nshall not be considered to have been arrested and may be held at the locations\nspecified in KRS 610.220(1), after which the officer shall proceed with an  initial\ninvestigation as provided for in KRS 610.200.\n(3) When a child is taken into custody by a person other than a peace officer, such\nperson shall as soon as possible place the child in the custody of a peace officer.","path":["KRS Chapter 610"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43970","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:07Z","sha256":"daca1e451a195e5ed337722d80297b32836ad0dc80dfee7f2bf21595440f3559","source_id":"us-ky","stale":false,"prev":"us-ky/krs-610.180","next":"us-ky/krs-610.200"},"notice":"GroundRules: Original legal text.
