{"data":{"id":"us-ky/krs-610.220","jurisdiction":"us-ky","citation":"KRS 610.220","heading":"Permitted purposes for holding child in custody -- Time limitation --","body":"Extension -- Separation from adult prisoners -- Prohibition against attaching\nchild to stationary object.\n(1) Except as otherwise provided by statute, if an officer takes or recei ves a child into\ncustody on an allegation of committing a public offense or into protective custody\non being a suspected runaway, the child may be held at a police station, secure\njuvenile detention facility, youth alternative center, a nonsecure facility,  or, as\nnecessary, in a hospital or clinic for the following purposes:\n(a) Identification and booking;\n(b) Attempting to notify the parents or person exercising custodial control or\nsupervision of the child, a relative, guardian, other responsible person, or the\ncabinet;\n(c) Photographing;\n(d) Fingerprinting;\n(e) Physical examinations, including examinations for evidence;\n(f) Evidence collection, including scientific tests;\n(g) Records checks;\n(h) Determining whether the child is subject to trial as an adult; and\n(i) Other inquiries of a preliminary nature.\n(2) A child may be held in custody pursuant to this section for a period of time not to\nexceed two (2) hours, unless an extension of time is granted. Permission for an\nextension of time may be granted by the court, trial commissioner, or court -\ndesignated worker pursuant to KRS 610.200(6)(d) and the child may be retained in\ncustody for up to an additional ten (10) hours at a facility of the type listed in\nsubsection (1) of this section except for an intermi ttent holding facility for the\nperiod of retention.\n(3) Any child held in custody pursuant to this section shall be sight and sound separated\nfrom any adult prisoners held in secure custody at the same location, and shall not\nbe handcuffed to or otherwise securely attached to any stationary object.","path":["KRS Chapter 610"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43972","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:07Z","sha256":"a1b907a923ba79af25e7a7afe9f95518dabab7971ba6cbba48820bfc466c5f2a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-610.210","next":"us-ky/krs-610.230"},"notice":"GroundRules: Original legal text.
