{"data":{"id":"us-ky/krs-610.295","jurisdiction":"us-ky","citation":"KRS 610.295","heading":"Detention costs -- Assessment against parent after hearing -- Payments","body":"when adjudication based on status offense or public offense -- Payment\nschedule and discharge.\n(1) Any statute to the contrary notwithstanding, detention costs shall not be assesse d by\na court against a parent unless the court has conducted a hearing and has\ndetermined:\n(a) That the child has previously been adjudicated as a habitual truant under KRS\nChapter 630, a public offender under KRS Chapter 635, or a youthful offender\nunder KRS Chapter 640, and now stands adjudicated guilty of a subsequent\nhabitual truancy or public offense, or is now being considered for transfer to\nthe Circuit Court for trial as a youthful offender; and\n(b) That the failure or neglect of the parent to prope rly supervise or control the\nchild is a substantial contributing factor of the act or acts of the child upon\nwhich the proceeding is based; and\n(c) That the parent has the financial ability to pay any fees ordered.\n(2) Any orders for payment shall direct t hat payments be made to the fiscal court or\nlegislative body of a consolidated local government, urban -county government, or\ncharter government if detention is based upon adjudication related to a status\noffense and to the Department of Juvenile Justice if the adjudication is based upon a\npublic offense or transfer as a youthful offender.\n(3) The fiscal court or legislative body of a consolidated local government, urban -\ncounty government, or charter government or the Department of Juvenile Justice, as\nappropriate, shall establish a payment schedule for parents against whom detention\ncosts have been assessed, and may discharge any remaining portion of the debt upon\nproof of substantial change in circumstances of the parent.\n(4) The authority granted under subsection (3) of this section may be applied to all pre -\nexisting court orders assessing detention costs in effect on July 15, 2002.","path":["KRS Chapter 610"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=20166","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:07Z","sha256":"069ca8c8d23d63f9e6029c600cfc2a435a6cf37cbc922d09eb14ae8670a3b073","source_id":"us-ky","stale":false,"prev":"us-ky/krs-610.290","next":"us-ky/krs-610.300"},"notice":"GroundRules: Original legal text.
