{"data":{"id":"us-ky/krs-620.020","jurisdiction":"us-ky","citation":"KRS 620.020","heading":"Definitions for chapter.","body":"The definitions in KRS  Chapter 600 shall apply to this chapter. In addition, as used\nin this chapter, unless the context requires otherwise:\n(1) \"Case permanency plan\" means a document identifying decisions made by the\ncabinet, for both the biological family and the child, concerning action which\nneeds to be taken to assure that the child in foster care expeditiously obtains a\npermanent home;\n(2) \"Case  progress report\" means  a written record of goals that have been\nachieved in the case of a child;\n(3) \"Case record\" means a cabinet file of specific documents and a running record\nof activities pertaining to the child;\n(4) \"Children's advocacy center\" means  an agency that advocates on behalf of\nchildren alleged to have been abused; that assists in the coordination of the\ninvestigation of child abuse by providing a location for forensic interviews and\nmedical examinations, and by promoting the coordination of services for\nchildren alleged to have been  abused; and that provides, directly or by\nformalized agreements, services that include, but are not limited to, forensic\ninterviews, medical examinations, mental health and related support services,\ncourt advocacy, consultation, training, and staffing of multidisciplinary teams;\n(5) \"Foster care\" means the provision of temporary twenty-four (24) hour care for a\nchild for a planned period of time when the child is:\n(a) Removed  from his parents or person exercising custodial control or\nsupervision and subsequently placed in the custody of the cabinet; and\n(b) Placed in a foster home  or private child-caring facility or child-placing\nagency but remains under the supervision of the cabinet;\n(6) \"Local citizen foster care review board\" means a citizen board which provides\nperiodic permanency reviews of children placed in the custody of the cabinet\nby a court order of temporary custody or commitment under this chapter;\n(7) \"Multidisciplinary teams\"  means  local teams  operating under  protocols\ngoverning roles, responsibilities, and procedures developed by the Kentucky\nMultidisciplinary Commission on Child Sexual Abuse pursuant to KRS 431.600;\n(8) \"Pediatric abusive head trauma\" means the various injuries or conditions that\nmay  result following the vigorous shaking, slamming, or impacting the head of\nan infant or young child. These injuries or conditions, also known as pediatric\nacquired abusive head trauma, have in the past been called \"Shaken Baby\nSyndrome\"  or \"Shaken Infant Syndrome.\" Pediatric abusive head  trauma\ninjuries or conditions have included but are not limited to the following:\n(a) Irreversible brain damage;\n(b) Blindness;\n(c) Retinal hemorrhage;\n(d) Eye damage;\n(e) Cerebral palsy;\n(f) Hearing loss;\n(g) Spinal cord injury;\n(h) Paralysis;\n(i) Seizures;\n(j) Learning disability;\n(k) Death;\n(l) Central nervous system injury as evidenced by central nervous system\nhemorrhaging;\n(m) Closed head injury;\n(n) Rib fracture; and\n(o) Subdural hematoma;\n(9) \"Permanence\"  means  a relationship between a child and an adult which is\nintended to last a lifetime, providing commitment and continuity in the child's\nrelationships and a sense of belonging;\n(10) \"Position of authority\" has the same meaning as in KRS 532.045;\n(11) \"Position of special trust\" has the same meaning as in KRS 532.045;\n(12) \"Preventive services\" means  those services which are designed to help\nmaintain and strengthen the family unit by preventing or eliminating the need\nfor removal of children from the family;\n(13) \"Reasonable efforts\" means the exercise of ordinary diligence and care by the\ndepartment to utilize all preventive and reunification services available to the\ncommunity in accordance with the state plan for Public Law 96-272 which are\nnecessary to enable the child to safely live at home;\n(14) \"Reunification services\" means  remedial and preventive services which are\ndesigned to strengthen the family unit, to secure reunification of the family and\nchild where appropriate, as quickly as practicable, and to prevent the future\nremoval of the child from the family; and\n(15) \"State citizen foster care review board\" means  a board created by KRS\n620.310.","path":["KRS Chapter 620"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48527","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:07Z","sha256":"ebc9278b33ad2a4ff8b94ccd66f6d0793981f5822708261ae51a018a818aed20","source_id":"us-ky","stale":false,"prev":"us-ky/krs-620.010","next":"us-ky/krs-620.023"},"notice":"GroundRules: Original legal text.
