{"data":{"id":"us-ky/krs-620.029","jurisdiction":"us-ky","citation":"KRS 620.029","heading":"Duties of cabinet relating to children who are victims of human trafficking","body":"-- Reporting requirements.\n(1) In order to provide the most effective treatment for children who are victims of\nhuman trafficking, as defined in KRS 529.010, and to  ensure that law enforcement\nand prosecutorial agencies have the resources and tools necessary to combat human\ntrafficking, the cabinet shall:\n(a) Investigate a report alleging a child is a victim of human trafficking pursuant\nto KRS 620.030(3);\n(b) Provide or ensure the provision of appropriate treatment, housing, and\nservices consistent with the status of the child as a victim of human\ntrafficking; and\n(c) Proceed in the case in accordance with applicable statutes governing cases\ninvolving dependency, neg lect, or abuse regardless of whether the person\nbelieved to have caused the human trafficking of the child is a parent,\nguardian, or person exercising custodial control or supervision.\n(2) In order to effectuate the requirements of this section, the cabinet shall:\n(a) Consult with agencies serving victims of human trafficking to promulgate\nadministrative regulations for the treatment of children who are reported to be\nvictims of human trafficking as dependent, neglected, or abused children,\nincluding providing for appropriate screening, assessment, treatment, services,\ntemporary and long -term placement of these children, training of staff, the\ndesignation of specific staff, and collaboration with service providers and law\nenforcement;\n(b) By November 1 of each year, submit to the Legislative Research Commission\na comprehensive report detailing:\n1. The number of reports the cabinet has received regarding child victims\nof human trafficking;\n2. The number of reports in which the cabinet has investigated and\ndetermined that a child is the victim of human trafficking; and\n3. The number of cases in which services were provided; and\n(c) 1. Beginning in 2025, in addition to the information required un der\nparagraph (b) of this subsection, include in its annual report to the\nLegislative Research Commission for referral to the Interim Joint\nCommittee on Families and Children and the Interim Joint Committee\non Judiciary to the extent possible:\na. Information related to state enforcement of human trafficking\ninvolving children in the Commonwealth, including the number\nof:\ni. Arrests as compiled by the Department of Kentucky State\nPolice; and\nii. Criminal charges and convictions, delineated by county or\ndistrict, as compiled by the Administrative Office of the\nCourts;\nb. The frequency at which services were made available to child\nvictims of human trafficking;\nc. Recommendations for improving data collection so that\ninformation may be obtained and analyzed in a larger percentage\nof cases;\nd. Recommendations for improving data sharing among service\nproviders, nongovernmental organizations, and government\nagencies; and\ne. Any other information that may assist in understanding the\ncausation of human trafficking of  children in Kentucky and\nstakeholders' abilities to provide services to victims.\n2. If, after making reasonably diligent efforts to obtain the information\ndescribed in subparagraph 1. of this paragraph, the cabinet is unable to\nobtain any of the informati on, the cabinet may submit an annual report\nomitting that information, but shall provide an explanation for the\nomission in the annual report.","path":["KRS Chapter 620"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54880","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:08Z","sha256":"3be0bf7fa3ee7693482d0c0d7182c7800f0f8539555a6e7a49b50fb6c1d9fab3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-620.027","next":"us-ky/krs-620.030"},"notice":"GroundRules: Original legal text.
