{"data":{"id":"us-ky/krs-620.142","jurisdiction":"us-ky","citation":"KRS 620.142","heading":"Custodial, permanency, and service options available to relative or fictive","body":"kin caregiver of an abused, neglected, or dependent child -- Application\ntimeframe for relative or fictive kin caregiver to become a relative or fictive\nkin foster parent.\n(1) The cabinet shall develop custodial, permanency, and service options, including but\nnot limited to monetary supports, that shall be available to a relative or fictive kin\ncaregiver in the instance that a child, who would otherwise be placed  in another\nout-of-home placement, is placed with him or her due to a cabinet finding that the\nchild is abused, neglected, or dependent, as determined by an assessment or\ninvestigation conducted in accordance with this chapter. The custodial,\npermanency, and service options available to a relative or fictive kin caregiver shall\ninclude but not be limited to:\n(a) A notification form that explains and describes the process by which a relative\nor fictive kin caregiver can be certified as a child -specific foster home and the\nfinancial and support benefits that come with that type of placement;\n(b) A program for a one (1) time monetary benefit as established by an\nadministrative regulation promulgated in accordance with KRS Chapter 13A\nper child given to the rela tive or fictive kin caregiver at the time a child is\nplaced with the relative or fictive kin caregiver; and\n(c) A detailed placement packet that lists all types of supports, financial and\notherwise, that are available to a relative or fictive kin caregiver  given to the\nrelative or fictive kin caregiver at the time a child is placed with the relative or\nfictive kin caregiver.\n(2) The cabinet shall disclose to a prospective relative or fictive kin caregiver each of\nthe options established in subsection (1) of  this section prior to the child's\nplacement. The prospective relative or fictive kin caregiver shall select the option\nthat best represents the level of care and support needed for the child while the child\nis receiving treatment and care in the placement  with the relative or fictive kin\ncaregiver.\n(3) Within one hundred twenty (120) days of a placement made by the cabinet due to a\ncabinet finding that a child is abused, neglected, dependent, or a status offender, or\nupon a qualifying event as established in administrative regulation, a relative or\nfictive kin caregiver may apply to become a relative or fictive kin foster parent for\nthe child in his or her care.\n(4) The custodial, permanency, and service options required by subsection (1) of this\nsection shall reflect nationally recognized best practices.\n(5) The cabinet shall maximize services available under federal and state law, including\nbut not limited to Titles IV and XIX of the Social Security Act, to fulfill the\nrequirements of this section.\n(6) The cabinet shall, if necessary, seek any state or federal waivers to implement the\nprovisions of subsection (3) of this section.\n(7) The cabinet shall promulgate administrative regulations in accordance with KRS\nChapter 13A to implement this section.","path":["KRS Chapter 620"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54940","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:08Z","sha256":"2d3ade2cae0b8161832680f05940114d9073cdc028a2297e902d7169e05bfeb9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-620.140","next":"us-ky/krs-620.145"},"notice":"GroundRules: Original legal text.
