{"data":{"id":"us-ky/krs-620.145","jurisdiction":"us-ky","citation":"KRS 620.145","heading":"Cabinet's assessment of child's educational needs.","body":"(1) Within sixty (60) days of the commitment date of a child due to abuse, neglect, or\ndependency, the Cabinet for Health and Family Services shall provide the court\nwith jurisdiction an assessment of the child to determine:\n(a) The child's current and historical educational functioning;\n(b) The child's emotional and behavioral functioning; and\n(c) The extent to which the child's life experiences and circumstances of\ncommitment have created a disabling condition requiring special educational\nprogramming or othe r services to provide the child an appropriate public\neducation.\n(2) Upon discerning of an emotional, behavioral, or other disabling condition with\nnegative impact upon a child's educational experience, the Cabinet for Health and\nFamily Services as guardia n of the child shall ensure that whatever services\nnecessary are obtained to allow the child the benefit of a free, appropriate public\neducation.\n(3) Services required to allow the child a free, appropriate public education shall be\nlimited to those requir ed under Section 504 of Pub. L. 93 -112, Pub. L. 94 -142, or\nother federal statutes affecting children with emotional or behavioral disabilities.\n(4) The Cabinet for Health and Family Services shall include activities undertaken to\nensure a child committed t o the Cabinet for Health and Family Services receives\nadequate public education in the six (6) month case progress report required by\nKRS 620.240.\n(5) Any child removed from his home due to abuse, neglect, or dependency and placed\nin the least restrictive appropriate placement available shall, for the purposes of\nacquiring an appropriate public education, be considered a resident of the school\ndistrict where the placement occurs.\n(6) The Cabinet for Health and Family Services shall provide a copy of the ass essment\nrequired by subsection (1) of this section to the foster parent, or other agency or\nentity providing residential care to a committed child, within five (5) days of filing\nthe assessment with the court.","path":["KRS Chapter 620"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=20202","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:08Z","sha256":"e059aa3200fe0f071852c202161dfdc5207590fc72c330eaa68ebb2ef62f540c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-620.142","next":"us-ky/krs-620.146"},"notice":"GroundRules: Original legal text.
