{"data":{"id":"us-ky/krs-620.363","jurisdiction":"us-ky","citation":"KRS 620.363","heading":"Rights of foster child.","body":"A  child who  is placed in foster care shall be considered a primary partner and\nmember  of a professional team. A foster child, as the most integral part of the\nprofessional team, shall have the following rights to:\n(1) Adequate food, clothing, and shelter;\n(2) Freedom  from physical, sexual, or emotional injury or exploitation;\n(3) Develop physically, mentally, and emotionally to his or her potential;\n(4) A safe, secure, and stable family;\n(5) Individual educational needs being met;\n(6) Remain  in the same educational setting prior to removal, whenever possible;\n(7) Placement in the least restrictive setting in close proximity to his or her home\nthat meets his or her needs and serves his or her best interests to the extent\nthat such placement is available;\n(8) Information about the circumstances requiring his or her initial and continued\nplacement;\n(9) Receive notice of, attend, and be consulted in the development of case plans\nduring periodic reviews;\n(10) Receive notice of and participate in court hearings;\n(11) Receive  notice of and explanation for changes in placement or visitation\nagreements;\n(12) Visit the family in the family home, receive visits from family and friends, and\nhave telephone conversations with family members, when not contraindicated\nby the case plan or court order;\n(13) Participate in extracurricular, social, cultural, and  enrichment activities,\nincluding but not limited to sports, field trips, and overnights;\n(14) Express  opinions on  issues concerning his or her placement, care, or\ntreatment;\n(15) Three (3) additional rights if he or she is age fourteen (14) years or older.\nThese additional three (3) rights are the right to:\n(a) Designate two (2) additional individuals to participate in case planning\nconferences or periodic reviews, who are not the foster parent or his or\nher worker, and who may  advocate on his or her behalf. The cabinet,\nchild-caring facility, or child-placing agency may reject an individual with\nreasonable belief that the individual will not act appropriately on the\nchild's behalf;\n(b) Receive a written description of the programs and services that will help\nprepare him or her for the transition from foster care to successful\nadulthood; and\n(c) Receive a consumer  report yearly until discharged from care and to\nreceive assistance in interpreting and resolving any inaccuracies in the\nreport, pursuant to 42 U.S.C. sec. 675(5)(I);\n(16) Receive, free of charge when he or she is eighteen (18) years or older and\npreparing to exit foster care by reason of attaining the age of eighteen (18)\nyears old, the following:\n(a) An official birth certificate;\n(b) A Social Security card;\n(c) Health insurance information;\n(d) A state-issued identification; and\n(e) A copy of the child's cabinet case history, including:\n1. Family medical history;\n2. Placement history records; and\n3. The  child's medical records, including physical, dental, vision, and\nmental health records;\n(17) Request  placement be made  where he or she feels the most safe and\naccepted;\n(18) Participate in a sibling or half-sibling's court hearing if deemed  appropriate by\nthe cabinet, court of jurisdiction, and guardian ad litem, if applicable; and\n(19) Raise his or her child and make decisions on behalf of his or her child unless a\nhealth or safety risk is determined by the cabinet or due to the treatment needs\nof the youth.","path":["KRS Chapter 620"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52107","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:08Z","sha256":"da76064e129324f111e21e8633d83e1fcd73a5fc04fc10e63c9b60c4f6ca7de3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-620.360","next":"us-ky/krs-620.365"},"notice":"GroundRules: Original legal text.
