{"data":{"id":"us-ky/krs-63.120","jurisdiction":"us-ky","citation":"KRS 63.120","heading":"Appeal to Court of Appeals.","body":"(1) Any peace officer removed from office under the provisions of KRS 63.110 may,\nwithin ten (10) days from the date of the entry of the order removing him, appeal to\nthe Court of Appeals by obtaining from the Secretary of State a certified copy of all\ncharges, findings of fact and orders entered in the proceedings against him and\nfiling them with the clerk of the Court of Appeals, and entering a motion before the\nclerk for an appeal. The motion shall set forth the alleged errors of fact and law\ncommitted by the Governor. No response shall be filed to the motion. The Governor\nshall be made appellee in the appeal, and notice thereof shall be served upon the\nGovernor immediately after the motion is filed with the clerk. If the Governor is out\nof his office or away from the seat of government, the notice shall be served on the\nAttorney General or one (1) of the assistants in his office. The Secretary of State\nshall, after the appeal has been filed, immediately deliver the original record to the\nclerk of the Court of Appeals, and append thereto a certificate showing that it is the\nentire record in the case on file.\n(2) The judgment of the court shall be final and shall be certified to the Secretary of\nState. If the order of removal entered by the Governor is affirmed it shall become\neffective immediately and the office held by the peace officer shall be deemed\nvacant.\n(3) The original papers in the case shall be returned to the Secretary of State after the\ncase has been disposed of in the Court of Appeals.","path":["KRS Chapter 63"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23162","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:17Z","sha256":"789e399884d13510056f436432142500baf5ff0fdc1c5ea600662aceb033273f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-63.110","next":"us-ky/krs-63.130"},"notice":"GroundRules: Original legal text.
