{"data":{"id":"us-ky/krs-635.110","jurisdiction":"us-ky","citation":"KRS 635.110","heading":"Human immunodeficiency virus testing for juveniles accused of certain","body":"sexual offenses -- Results -- Counseling when test positive.\n(1) A juvenile session of a District Court shall comply with the provisions of KRS\n510.320 when a child is accused of commission of a public offense as described\ntherein.\n(2) A juvenile session of a District Court shall order a child who is adjudicated a public\noffender to submit to a human immunodeficiency virus test pursuant to KRS\n510.320 if the offense is one described therein.\n(3) (a) The result of any human immunodeficiency virus test conducted pursuant to\nthis section shall not be a public record for purposes of KRS Chapter 61.\n(b) The result of any human immunodeficiency virus test conducted pursuant to\nthis section shall only be made available by the Department of Juvenile Justice\nto the victim, the parent or guardian of a victim who is a minor or is an\nindividual with an intellectual disability or mentally incapacitated, the child\nadjudicated as a public offender and his parents or guardian, the court issuing\nthe order for testing, and as otherwise directed pursuant to KRS Chapter 214.\n(4) If the human immunodeficiency virus test indicates the presence of human\nimmunodeficiency virus infection, the Department of Ju venile Justice shall provide\ncounseling to the victim and the juvenile offender regarding human\nimmunodeficiency virus disease and referral for appropriate health care and support\nservices.","path":["KRS Chapter 635"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40865","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:09Z","sha256":"a5c34903a639e56716caeeb65d7e80a76f94030862b7059bf824f8cee3c0eb1c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-635.100","next":"us-ky/krs-635.120"},"notice":"GroundRules: Original legal text.
