{"data":{"id":"us-ky/krs-64.018","jurisdiction":"us-ky","citation":"KRS 64.018","heading":"Advancement to county clerk -- Conditions -- Administrative regulations.","body":"(1) (a) A county clerk in a county containing a population of less than seventy\nthousand (70,000) may be entitled to receive an advancement to:\n1. Defray necessary official expenses; and\n2. Supplement the payment of the salaries of the county clerk or the  county\nclerk's deputies and assistants.\n(b) 1. The secretary of the Finance and Administration Cabinet shall, on the\nfirst day of each calendar month, determine the necessary amount that\nmay be advanced to the county clerk.\n2. The advance shall be the lesser of:\na. One-twelfth (1/12) of the total fees collected by the county clerk\nfor the preceding year; or\nb. Sixty thousand ($60,000) dollars per month.\n(c) When approved by the secretary of the Finance and Administration Cabinet, a\nwarrant shall be drawn o n the State Treasury in favor of the county clerk for\nsuch advancement.\n(d) Funds advanced under this section shall be repaid by the county clerk to\nwhom the funds were advanced no later than the close of the calendar year in\nwhich the funds were advanced.  If the funds are not timely repaid, then the\ncounty clerk in his or her official capacity or the surety for the county clerk\nshall be liable to the Commonwealth.\n(2) If a county clerk makes a request for funds from the State Treasury to defray\nnecessary o fficial expenses, the county clerk shall not be required to submit a\ndetailed statement of his or her personal assets and liabilities as a condition of the\napplication process.\n(3) The Finance and Administration Cabinet shall promulgate administrative\nregulations in accordance with KRS Chapter 13A as necessary to implement the\nprovisions of this section.","path":["KRS Chapter 64"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52557","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:18Z","sha256":"5c94d9d21c5d9eef233d65ccda8a5e90e4a626e0f3ccca9cf0e1071f3588206c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-64.017","next":"us-ky/krs-64.019"},"notice":"GroundRules: Original legal text.
