{"data":{"id":"us-ky/krs-64.050","jurisdiction":"us-ky","citation":"KRS 64.050","heading":"Collection of fees and payment after leaving office.","body":"(1) When the term of any county clerk in counties of seventy -five thousand (75,000)\npopulation or over expires, or he dies or resigns, or is removed from office, he or\nhis personal representative, trustee, or committee, as the case may be, shall at once\ndeliver to his successor in office all accounts, claims, and fees due him in his\nofficial capacity. The successor shall have the fees, claims, and accounts collected,\nor the Department for Local Government may, in its discretion, when said accounts,\nfees, and claims are so delivered to the successor, appoint a person to collect them.\nIf a collector is appointed, the successor shall at once, or when demanded by the\ncollector, deliver to him all accounts, fees, and claims uncollected. The successor or\ncollector, as  the case may be, shall, every sixty (60) days after receiving the\naccounts, fees, and claims, report to the Department for Local Government, under\noath, the amount collected thereon, and at the same time pay to the Department for\nLocal Government the amount so collected, and shall continue to so report for three\n(3) years, unless the accounts, fees, and claims are sooner collected.\n(2) The Department for Local Government shall, upon each payment, draw a warrant\non the State Treasurer in favor of the person  collecting, for an amount equal to\ntwenty percent (20%) of the amount so paid in, which shall be the full\ncompensation allowed for the collection.\n(3) If the amount paid to any clerk during his term or incumbency was not sufficient to\npay the salaries and  office expenses of the clerk, the Department for Local\nGovernment shall, out of the money collected and paid in as provided in subsection\n(1) of this section, pay to the clerk, or to the person entitled to receive the same, an\namount sufficient to supply the deficit due for salaries and expenses, not exceeding\nseventy-five percent (75%) of the amount of fees accrued during his official term\nand which have been collected and paid to the Department for Local Government.","path":["KRS Chapter 64"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23184","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:18Z","sha256":"605a8d11e44a3922847d4ba83e1dde18057f37e31a594f18b70d28c71e4f1601","source_id":"us-ky","stale":false,"prev":"us-ky/krs-64.040","next":"us-ky/krs-64.055"},"notice":"GroundRules: Original legal text.
