{"data":{"id":"us-ky/krs-64.070","jurisdiction":"us-ky","citation":"KRS 64.070","heading":"Officers conveying prisoners.","body":"(1) (a) Except as provided in KRS 441.540, an officer conveying a prisoner to the\npenitentiary shall be paid out of the State Treasury the rate per mile paid state\nemployees for official travel in privately -owned vehicles, as established by\nadministrative regulation of the Finance and Administration Cabinet, pursuant\nto KRS Chapter 13A, to be calculated by the nearest traveled route, and shall\nbe paid all actual necessary expenses for feeding, lodging and transporting the\nprisoner;\n(b) Upon the production of the re ceipt of the warden of the penitentiary for the\ndelivery of a prisoner, and a complete verified account of all expenses\nincurred, giving the names of the guards employed and distance traveled, the\nFinance and Administration Cabinet shall audit the account of the officer for\nconveying the prisoner and, if found correct, draw a warrant for its payment.\n(2) (a) For conveying a prisoner charged with a felony from one (1) county to\nanother, an officer shall receive the same mileage and expenses allowed for\nconveying a prisoner to the penitentiary, to be paid out of the State Treasury\nexcept as provided in KRS 441.530;\n(b) Upon the production of the receipt of the jailer of the county to which the\nprisoner is transferred, and a complete verified account of all exp enses\nincurred, giving the names of the guards employed and the distance traveled,\nthe Finance and Administration Cabinet shall audit the account of the officer\nfor conveying the prisoner and if found correct shall draw a warrant for its\npayment.\n(3) (a) For arresting a person charged with a misdemeanor upon a warrant issued\nfrom another county, and conveying the person to the county jail of the county\nfrom which the warrant issued, an officer shall be paid out of the county\ntreasury of the county from whic h the warrant was issued the same mileage\nand expenses allowed for conveying a prisoner to the penitentiary;\n(b) The officer shall present to the county judge/executive of the county from\nwhich the warrant issued a verified and itemized statement of his mi leage and\nexpenses and the county judge/executive shall direct the county treasurer to\npay the same out of the county treasury.\n(4) For conveying a prisoner charged with a felony to the jail of the county in which he\nwas arrested, an officer shall be paid out of the State Treasury the rate per mile paid\nstate employees for official travel in privately -owned vehicles, as established by\nadministrative regulation of the Finance and Administration Cabinet, adopted\npursuant to KRS Chapter 13A, for each mile traveled in going and returning.\n(5) The number of guards employed in conveying prisoners to the penitentiary or from\none (1) county to another shall not exceed one (1) for every two (2) prisoners.\nWhere only one (1) prisoner is conveyed no guard shall be empl oyed, except that\nthe Circuit Judge may appoint one (1) guard for each prisoner to the nearest railroad\nstation.","path":["KRS Chapter 64"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23190","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:18Z","sha256":"a948ddf859dcdf5d732d01075aed9dc08f8f414b140c5b8e4de8fd7b4242774b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-64.060","next":"us-ky/krs-64.080"},"notice":"GroundRules: Original legal text.
