{"data":{"id":"us-ky/krs-64.121","jurisdiction":"us-ky","citation":"KRS 64.121","heading":"Salaries and other necessary expenses of sheriff and deputies to be paid on","body":"the sheriff's death or incapacity in counties with population less than 70,000 --\nApplicability of KRS 64.368 if population decreases below 70,000.\n(1) \"Incapacity\" means a condi tion under which a sheriff or his or her personal\nrepresentative may apply to the Circuit or District Judge that presides over the\nsheriff's county for an order to determine that the sheriff is physically or mentally\nunable to discharge the duties of his o r her office. The application to the Circuit or\nDistrict Judge shall include and be supported by an affidavit by the sheriff's\nphysician documenting the sheriff's incapacitating condition.\n(2) If a sheriff in a county containing a population of less than s eventy thousand\n(70,000) dies or is incapacitated during his or her term of office, the fiscal court of\nthat county shall on or before the first day of March of the year following the death\nor date of incapacity of the sheriff pay to the sheriff or to the personal representative\nof the sheriff sufficient money to reimburse the sheriff or his or her estate for the\nsalaries of his deputies and assistants and other necessary expenses of his or her\noffice that were paid by the sheriff during the year of his or her death or incapacity.\nAdditionally, for each month that the sheriff or his or her personal representative\nperformed the duties of sheriff during the year of his or her death or incapacity, the\nfiscal court shall pay to the sheriff or to the sheriff's pe rsonal representative a sum\nof money equal to one -twelfth (1/12) of the total salary received by the county's\nsheriff in the year prior to the year of the death or incapacity. The sheriff's salary\nand all fees and commissions paid to the sheriff during the  year of his or her death\nor incapacity shall be deducted from the amount that the sheriff or his or her\npersonal representative is to receive by this section.\n(3) If a county's population that equaled or exceeded seventy thousand (70,000) is less\nthan seventy thousand (70,000) after the most recent federal decennial census, then\nthe provisions of KRS 64.368 shall apply.","path":["KRS Chapter 64"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23199","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:18Z","sha256":"a92c63053c7c7780c25676afb230184c60d26dc7cfb60c6f2df494df440095f6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-64.120","next":"us-ky/krs-64.125"},"notice":"GroundRules: Original legal text.
