{"data":{"id":"us-ky/krs-64.140","jurisdiction":"us-ky","citation":"KRS 64.140","heading":"Advancement to sheriffs for expenses.","body":"(1) Any sheriff may be entitled to receive an advancement to defray necessary official\nexpenses and to apply to the payment of the salaries of the sheriff or the sheriff's\ndeputies and assistants. The secretary of the Finance and Administration Cabinet\nshall, on the first day of each calendar month, determine the necessary amount that\nmay be advanced to the sheriff, which amount shall not exceed one -twelfth (1/12)\nof the total fees collected by the sheriff for the preceding year and may be for a less\namount, and in no event shall it exceed sixty thousand ($60,000) dollars per month.\nWhen approved by the secretary of the Finance and Administration Cabinet, a\nwarrant shall be drawn on the State Treasury in favor of the sheriff for such\nadvancement. At the end of e ach calendar year the sum of such advancements shall\nbe deducted from the part of the total of fees and commissions paid into the State\nTreasury by the sheriff, pursuant to Section 106 of the Constitution of Kentucky,\nthat is available for use for the paym ent of the salaries of the sheriff, the sheriff's\ndeputies and assistants, and necessary office expenses.\n(2) If the office of sheriff becomes vacant, the sums advanced under this section shall\nbe charged against that part of the fees and the commissions o f the office of the\nsheriff that have been, or shall be, paid into the State Treasury during the calendar\nyear in which the advancements were made, and that is available for payment of the\nsalaries of the sheriff, the sheriff's deputies and assistants, and  necessary expenses\nof the office.\n(3) If the total of fees and commissions paid into the State Treasury by the sheriff for\nany calendar year is insufficient to match the amount of advancements made to the\nsheriff, his or her sureties and the sheriff in his or her official capacity shall be liable\nto the state for any excess of advancements over the total of fees and commissions\npaid into the State Treasury.\n(4) If a sheriff makes a request for funds from the State Treasury to defray necessary\nofficial expenses, the sheriff shall not be required to submit a detailed statement of\nhis or her personal assets and liabilities as a condition of the application process.","path":["KRS Chapter 64"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23202","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:18Z","sha256":"080aefff49394b3cb329ce1bf09aa5ba33d154103f3119b6ce4ff793be0a3a25","source_id":"us-ky","stale":false,"prev":"us-ky/krs-64.130","next":"us-ky/krs-64.150"},"notice":"GroundRules: Original legal text.
