{"data":{"id":"us-ky/krs-64.460","jurisdiction":"us-ky","citation":"KRS 64.460","heading":"Illegal fee-bill may be examined by Circuit Judge -- Proceedings.","body":"(1) Any person who pays any fee -bill or claim for fees which he believes contains an\nerroneous, improper or illegal item, or charge for services not actually rendered, or\ndoes not comport with the law in every respect, may hand the fee -bill to the Circuit\nJudge of the county in which he resides, and if there is any item in the fee -bill not\nauthorized by law or if it does not comport with the law in every respect, the Circuit\nJudge shall quash the fee -bill, and order the officer to repay the amount of the fee -\nbill to the person who paid it, and pay the costs of the proceeding.\n(2) The judge shall enter a fine against the officer who issued the fee -bill, in favor of\nthe person aggrieved, of not less than one dollar ($1.00) nor more than four dollars\n($4.00) for each illegal item contained therein. The production of the fee -bill by the\nparty charged shall be prima facie evidence of its payment.\n(3) If the judge is of the opinion that there is no improper charge or illegal item in the\nfee-bill, he shall restore it to  the person placing it in his hands, without costs or\nexpense.\n(4) A fieri facias, indorsed that no surety is to be taken, may issue in behalf of the\nperson aggrieved for all the sums and costs adjudged under this section.\n(5) Before any judgment is entered under the provisions of this section, the defendant in\nthe proceeding must be given at least two (2) days' notice thereof by rule or\notherwise.","path":["KRS Chapter 64"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23249","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:19Z","sha256":"4df2b46e2d2e22c1c8e819c704b9e9a73ba272fc66a7c200c20cdf9eeed8fb4d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-64.450","next":"us-ky/krs-64.470"},"notice":"GroundRules: Original legal text.
