{"data":{"id":"us-ky/krs-64.470","jurisdiction":"us-ky","citation":"KRS 64.470","heading":"Remedy for distress for illegal fee-bill.","body":"(1) If distraint is made upon the property of a person for a fee-bill that has any unjust or\nimproper charge or item therein, or any item not made out in every respect\nagreeably to the requirements of law, the person may apply to the officer making the\ndistraint for an exact copy of the fee -bill, and the officer shall make out and deliver\nthe same to such person forthwith.\n(2) Upon receipt of such copy, the person on whom the distraint is made may present it\nto the circuit judge of the county of his residence,  and if, on inspection thereof, the\njudge is of the opinion that the fee -bill contains any unjust item, or item not made\nout in every respect according to the requirements of law, he shall, by written\nindorsement thereon, order the officer to stay proceedi ngs under the distraint until\nthe matter is determined in court.\n(3) Upon the receipt of the order, the officer who made the distraint shall obey it,\nrestore the property distrained to the owner, and return the fee -bill and copy with\nthe judge's order the reon to the circuit clerk's office of his county, with the facts of\nthe case indorsed on the fee-bill.\n(4) The officer who issued the fee -bill shall be notified as directed in subsection (5) of\nKRS 64.460.\n(5) The court shall quash the fee -bill, and rend er judgment against the officer issuing\nthe same for the amounts and in the manner stated in KRS 64.460, and execution\nmay issue therefor.","path":["KRS Chapter 64"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23250","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:19Z","sha256":"f9dd4a85989db01b3fcf1cbcc05aad19ec1eedc0ccc9d40507591ed21b393f3e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-64.460","next":"us-ky/krs-64.475"},"notice":"GroundRules: Original legal text.
