{"data":{"id":"us-ky/krs-64.475","jurisdiction":"us-ky","citation":"KRS 64.475","heading":"Executive Branch Compensation Advisory Council -- Organization -- Staff -","body":"- Duties -- Recommendations.  (Effective April 1, 2021)\n(1) There is hereby established an advisory council to be known as the Executive\nBranch Compensation Advisory Council.\n(a) The council shall consist of three (3) voting members: the state budget\ndirector, the secretary of the Governor's Executive Cabinet, and the secretary\nof the Finance and Administration Cabinet.\n(b) The state budget director shall serve as the chair of the council.\n(c) If a voting member is unable to attend a meeting of the council, he or she shall\ndesignate, in writing, a member of his or her staff to attend in his or her place,\nand such designation shall confer on such designee, for that meeting only,  the\nauthority to act, including the right to vote on any matter coming before the\ncouncil.\n(2) The council shall be attached to the Personnel Cabinet for administrative purposes.\nPersonnel Cabinet staff shall provide necessary administrative and operation al\nsupport for the council. The council may, from time to time, utilize the services of\nprofessional and technical personnel employed by other agencies of state\ngovernment, if the need arises. The council shall meet on a quarterly basis at a time\nand place to be determined by the council. Additional meetings may be called upon\nrequest of two (2) voting members of the council.\n(3) The duties of the council shall include the following:\n(a) Advise and make recommendations to the secretary of the Personnel Cabi net\non appropriate salaries for the following:\n1. The heads of the various departments in the executive branch of state\ngovernment, with the exception of:\na. Departments headed by constitutionally elected officers;\nb. The Department of Education;\nc. The Council on Postsecondary Education; and\nd. The Kentucky Authority for Educational Television;\n2. The heads of offices, as defined in KRS 12.010;\n3. The administrative heads of boards and commissions and for their\nemployees, if they are not covered by the salary schedules set forth in\nKRS Chapter 16, KRS Chapter 18A, or KRS Chapter 151B,\nnotwithstanding any other statute to the contrary empowering a bo ard,\ncommission, authority, or other administrative body for which the\nPersonnel Cabinet provides personnel and payroll services except for\nany board governing any of the Kentucky Retirement Systems, the\nCounty Employees Retirement System, the Kentucky Pub lic Pensions\nAuthority, the Kentucky Higher Education Assistance Authority, the\nKentucky Authority for Educational Television, or the Council on\nPostsecondary Education to establish, set, or approve the salaries of its\nadministrative head and other employees;\n4. Requests from boards, commissions, or cabinet heads to approve salary\nincreases in excess of those increases provided other state employees to\nindividuals in the positions listed in paragraphs (a), (b), and (c) of this\nsubsection;\n(b) Advise the sec retary of the Personnel Cabinet on requests from agencies to\nestablish or abolish a separate salary schedule, or schedules, reflective of the\nmarketplace need to recruit and hire classified employees in technical or\nprofessional fields when the classified service salary schedule is inadequate. A\npositive recommendation of such requests shall not be granted unless\nsignificant credible evidence exists of a job market shortage and an\ninadequacy of the classified or unclassified salary schedules to recruit and\nretain competent, qualified applicants for such positions; and\n(c) Recommend that the Personnel Cabinet conduct salary surveys of the\nexecutive branch positions outlined in subsection (3)(a)1., 2., and 3. of this\nsection, using state governments in the sev en (7) states contiguous to the\nCommonwealth, other states in the southeastern United States, and private\nsector employers, where appropriate.\n(4) The council's recommendations shall:\n(a) Take into consideration the provisions of KRS 64.640, if the specifi c position\nin question is subject to the provisions of KRS 64.640; and\n(b) Not take into consideration the provisions of KRS 64.640, if the specific\nposition in question is exempt from the provisions of KRS 64.640.","path":["KRS Chapter 64"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50557","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:19Z","sha256":"b8f47092a4cfa23d7531f7d636bde9a63504055d8681533c7daf722793eda0c9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-64.470","next":"us-ky/krs-64.480"},"notice":"GroundRules: Original legal text.
