{"data":{"id":"us-ky/krs-64.640","jurisdiction":"us-ky","citation":"KRS 64.640","heading":"Compensation of state officers and employees generally.","body":"(1) Except as otherwise provided in subsection (2) of this section, and excepting\nofficers elected by popular vote, employees of the General Assembly, including\nemployees of the Legislative Research Commission, members of boards and\ncommissions, those officers  and employees of Kentucky Educational Television\nexempt from classified service as provided in KRS 18A.115, presidents and\nemployees of the state universities and the state colleges, officers employed by the\nDepartment of Kentucky State Police under KRS C hapter 16, employees whose\ncompensation is set by the Public Service Commission under KRS 278.040(4) and\n278.120(1), and persons employed by the commissioner of parks on a temporary\nbasis under KRS 148.026, the Personnel Cabinet shall prepare schedules of\ncompensation, payable out of the State Treasury, with a minimum salary rate, and\nother salary rates as are deemed necessary or advisable, for the office or position of\nemployment of every state officer and employee, including specifically the offices\nand p ositions of employment in every constitutional administrative department,\nstatutory administrative department, independent agency, board, commission, or\nother unit of state government. The language of any statute empowering a board,\ncommission, authority, or other administrative body for which the Personnel\nCabinet provides personnel and payroll services, except for any board governing\nany of the Kentucky Retirement Systems, the County Employees Retirement\nSystem, the Kentucky Public Pensions Authority, the  Kentucky Higher Education\nAssistance Authority, the Kentucky Authority for Educational Television, or the\nCouncil on Postsecondary Education, to establish, set, or approve the salaries of its\nadministrative head and other employees to the contrary notwith standing, the\nestablishment or setting of salaries for administrative heads or other employees\nshall be subject to the approval of the secretary of the Personnel Cabinet. The\nschedules and rates shall be based upon studies of the duties and responsibilitie s of\nthe offices and positions and upon a comparison with rates being paid for similar or\ncomparable services elsewhere, and in the preparation of such schedules, the\nPersonnel Cabinet shall ascertain and record the duties, responsibilities, and\nauthority pertaining to the various offices and positions in the state service, and\nclassify such positions in the manner provided in KRS 18A.030, 18A.035, 18A.110,\n18A.130, 18A.135, and 18A.150 to 18A.160. No such schedule shall become\neffective until it has been approved by the Governor by executive order.\n(2) The Governor shall set the compensation payable out of the State Treasury to each\nofficer or position in the state service, which officer or position heads a statutory\nadministrative department, independent a gency, or other unit of state government,\nexcept for those excluded under subsection (1) of this section. Such compensation\nshall be based upon studies of the duties and responsibilities and classification of\nthe positions by the Governor and upon a comparison with compensation being paid\nfor similar or comparable services elsewhere, provided, however, such\ncompensation shall not exceed the total taxable compensation of the Governor\nderived from state sources, the provisions of KRS 64.660 to the contrary\nnotwithstanding. For the purposes of this section, the total taxable compensation of\nthe Governor from state sources shall include the amount provided for\ncompensation to the Governor under KRS 64.480 and any benefits or discretionary\nspending accounts that are imputed as taxable income for federal tax purposes.\n(3) The compensation payable out of the State Treasury to officers and employees\nsubordinate to any office or position covered by subsection (2) of this section shall\nnot exceed the maximum rate estab lished pursuant to subsection (2) of this section\nfor such office or position, except with respect to physicians as provided in KRS\n64.655 and employees of the Public Service Commission not otherwise exempt\nfrom the requirements of this section under KRS 2 78.040(4) and 278.120(1) whose\ncompensation shall be fixed, within constitutional limits, by the Personnel Cabinet\nwith the approval of the Governor as provided in subsection (1) of this section.\n(4) Nothing in this section shall preclude the allowance of maintenance to officers and\nemployees of the state.","path":["KRS Chapter 64"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57099","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:19Z","sha256":"5ff59fdb275400d6fcee6c3fc710d1cc1a00caba846c9144b22d1c63d84d2676","source_id":"us-ky","stale":false,"prev":"us-ky/krs-64.630","next":"us-ky/krs-64.645"},"notice":"GroundRules: Original legal text.
