{"data":{"id":"us-ky/krs-640.075","jurisdiction":"us-ky","citation":"KRS 640.075","heading":"Youthful offender transferred to Department of Corrections may remain","body":"in custody of Department of Juvenile Justice -- Transfer -- Petition for\nreconsideration of probation and for early parole.\n(1) Any other provision of KRS Chapter 640 to the contrar y notwithstanding, any\nyouthful offender ordered transferred to the Department of Corrections under KRS\n640.030(2)(c) may, at the discretion of the Department of Juvenile Justice, after\nconsultation with the Department of Corrections, remain in the custody  of the\nDepartment of Juvenile Justice and in a Department of Juvenile Justice facility or\nprogram, until expiration of sentence or until the youthful offender is released on\nparole, but in no event past the age of twenty-one (21).\n(2) Any youthful offende r whose custody has been retained by the Department of\nJuvenile Justice under subsection (1) of this section may be immediately transferred\nto the Department of Corrections, at such location within this state as the\nDepartment of Corrections directs, if th e youthful offender causes any disruption to\nthe program or attempts to escape.\n(3) Any youthful offender who attains the age of twenty -one (21) while in the custody\nof the Department of Juvenile Justice shall be immediately transferred to the\nDepartment of Corrections at such location within this state as the Department of\nCorrections directs.\n(4) Any youthful offender whose custody has been retained under subsection (1) of this\nsection and who has not been released under other provision of law or delivere d to\nthe Department of Corrections under subsection (2) of this section, may, on one (1)\noccasion and after the completion of a minimum twelve (12) months additional\nservice of sentence, petition the sentencing Circuit Court for reconsideration of\nprobation and, except as provided in KRS 439.3401, may be considered for early\nparole eligibility.","path":["KRS Chapter 640"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=20316","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:09Z","sha256":"176404200d585171aeb73c89000977ff4b5a42794a7dec7e3a2dfd75cfc0ee1a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-640.070","next":"us-ky/krs-640.080"},"notice":"GroundRules: Original legal text.
