{"data":{"id":"us-ky/krs-645.110","jurisdiction":"us-ky","citation":"KRS 645.110","heading":"Recertification procedure.","body":"(1) If the petitioner or other interested person desires to continue a child's\nhospitalization beyond the initial sixty (60) days, he shall file a petition for\nrecertification before the original sixty (60) days expire. The procedures and rights\nspecified in KRS 645.050 to 645.100 apply to recertification petitions and hearings\nexcept as otherwise specified in this section.\n(2) The court may deny the petition or may authorize a continuation of the child's\nhospitalization for a period of no more than one hundred eighty (180) days.\n(3) If the child has been represented previously, the same attorney shall continue to\nrepresent him at the recertification hearing unless the court determines otherwise for\ngood cause.\n(4) The child shall be brought to the court for the  initial and subsequent recertification\nhearings unless the court determines the child's presence at all or part of the hearing\nis likely to have a harmful effect on the child's physical or mental health.\n(5) In evaluating the criteria specified in KRS 645 .090 at a recertification hearing, the\ncourt shall consider the child's prior treatment, the ability of the hospital to provide\nappropriate treatment, and the likelihood of future improvement through treatment.","path":["KRS Chapter 645"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=20334","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:10Z","sha256":"c42c560828a29b525a0041f12ce19620871e88768dd1891eca51b3a8b315b7a8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-645.105","next":"us-ky/krs-645.120"},"notice":"GroundRules: Original legal text.
