{"data":{"id":"us-ky/krs-645.230","jurisdiction":"us-ky","citation":"KRS 645.230","heading":"Rights of child, parent.","body":"(1) The child, parent or other person exercising custodial control or supervision of a\nchild hospitalized under this chapter shall be entitled to confer at regular intervals\nwith the treating or admitting physician or a member of the child's treatment team\nconcerning the child's condition, treatment, or diagnosis. The hospital or other\nproponent of certification may request that the parent or other person exercising\ncustodial control or supervision of a child be available for consultation and\ncooperation in connection with the treatment process and may seek a court order to\nrequire such cooperation.\n(2) A parent or other person exercising custodial control or supervision of a child who\nhas been hospitalized pursuant to KRS 645.030 may at any time file a notice t o\nwithdraw the child from the hospital. Upon receipt of such notice, the hospital may\ndischarge the child immediately to the custody of his parent or other person\nexercising custodial control or supervision, or if in the opinion of the treating\nphysician release would be seriously detrimental to the child's health, the physician\nshall:\n(a) Discharge the child to the custody of his parent or other person exercising\ncustodial control or supervision against medical advice, after advising them\nagainst discharge  and seeking their written acknowledgment that they have\nbeen so advised; or\n(b) Refuse to discharge the child for a period of no more than seventy -two (72)\nhours, exclusive of weekends and holidays, after receipt of the notice to\nwithdraw, provided that t he hospital or the physician files a petition for\ncertification within the three (3) days, exclusive of weekends and holidays, in\nwhich case the hospital may hold the child until the court's ruling following\nthe certification hearing.","path":["KRS Chapter 645"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=20346","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:10Z","sha256":"eced181ed01ff09bd66cb58a9a67d8cfc5c98e2a5124cb9e4d73c41a710f826d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-645.220","next":"us-ky/krs-645.240"},"notice":"GroundRules: Original legal text.
