{"data":{"id":"us-ky/krs-645.240","jurisdiction":"us-ky","citation":"KRS 645.240","heading":"Procedures when child objects to being discharged.","body":"(1) A child admitted to a hospital pursuant to KRS 645.030 may object to a discharge\nrequested by his parent or other person exercising custodial control or supervision\nby stating in writing his objection and his desire to remain as a patient.\n(2) If the hospital desires to continue observation, diagnosis, or treatment of the child, it\nshall notify the parent or other person exercising custodial control or supervision\nwithin three (3) days, exclusive of weekends and holidays, and may continue to treat\nthe child. The hospital shall also notify the parent or the person of his right to file\nwith the court a petition to discharge, stating the basis for the parent or other\nperson's belief that the child no longer meets the criteria set out in KRS 645.090.\n(3) Upon the filing of a petition to discharge, the procedures for certification hearings\nshall apply except that the parent or other person exercising custodial control or\nsupervision shall have the burden to demonstrate that the criteria for hospitalization\nare not met.","path":["KRS Chapter 645"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=20347","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:10Z","sha256":"0b6a98b81646c065190c07876013d345250c7b4b9558401b21e2aa620fd0d075","source_id":"us-ky","stale":false,"prev":"us-ky/krs-645.230","next":"us-ky/krs-645.250"},"notice":"GroundRules: Original legal text.
