{"data":{"id":"us-ky/krs-65.111","jurisdiction":"us-ky","citation":"KRS 65.111","heading":"Prohibition on local government billing landlord for emergency response","body":"fees -- Limitations.\n(1) As used in this section:\n(a) \"Emergency response\" means a response by any first responder to a reported\nincident that is of such an emergent natur e that jeopardizes or could\njeopardize personal safety or result in the destruction of property;\n(b) \"Emergency response fee\" means any charge or fee, other than a membership\ncharge or subscriber fee levied under KRS Chapter 273, imposed by a fire\ndepartment, whether paid or volunteer, ambulance provider, law enforcement\nagency, or other organization to cover the costs associated with an emergency\nresponse, including but not limited to costs incurred for labor, materials,\nsupplies, or equipment used or provided in the response; and\n(c) \"First responder\" means fire, police, and emergency medical personnel.\n(2) (a) No local government, special district, or other provider of any emergency\nresponse service shall submit any demand for payment or require a landlord to\npay any emergency response fee if the emergency response:\n1. Arises out of the actions of a residential tenant or his or her guest; and\n2. Was not the result of any failure by the landlord to maintain a building\nin compliance with applicable housing, building, plumbing, electrical,\nfire, health, or nuisance code requirements.\n(b) Nothing in paragraph (a) of this subsection shall prevent a local government,\nspecial district, or other provider of any emergency response service from\nsubmitting a demand for payment of an emergency response fee from a\nresponsible party.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56176","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:20Z","sha256":"581491105662156c8716559774f190a293435d47a4383fc8cc22bed298114255","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.110","next":"us-ky/krs-65.112"},"notice":"GroundRules: Original legal text.
