{"data":{"id":"us-ky/krs-65.112","jurisdiction":"us-ky","citation":"KRS 65.112","heading":"Compensation for sewage treatment utility property -- Eminent domain --","body":"Surcharge to customers.\n(1) The provisions of any other law, rule, or regulation notwithstanding, if any city,\ncounty, public body corporate or politic, or special district or subdistrict furnishes or\nproposes to furnish sewage treatment utility services to customers of another\nsewage treatment utility by means of all or any part of the installations owned or\npaid for by that other sewage treatment utility, then the city, county, pu blic body,\ndistrict, or subdistrict taking over or proposing to take over the customers shall pay\njust compensation for these installations prior to the time the customers are taken\nover. If an agreement for compensation is not reached, then just compensat ion for\nthe installations shall be payable by the city, county, public body, district, or\nsubdistrict after condemnation as provided for in the Eminent Domain Act of\nKentucky.\n(2) There is hereby granted to any city, county, public body corporate or politi c, or\nspecial district or subdistrict the power of eminent domain with respect to sewage\ntreatment plants, facilities, and installations owned by sewage treatment utilities.\nThis power of eminent domain shall be exercisable in the manner prescribed by the\nEminent Domain Act of Kentucky.\n(3) Any city, county, public body corporate or politic, or special district or subdistrict\nshall be entitled to surcharge customers so as to recover the amount of\ncompensation paid for installations acquired under this secti on by agreement or\ncondemnation.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23334","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:20Z","sha256":"c4591d704dfe0743d181cdd7341b802305fe1da4f9a1cc0d34588aef79bdac8b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.111","next":"us-ky/krs-65.113"},"notice":"GroundRules: Original legal text.
