{"data":{"id":"us-ky/krs-65.147","jurisdiction":"us-ky","citation":"KRS 65.147","heading":"Limitations on enforcement of unlawful camping law prohibited -- Civil","body":"action by Attorney General.\n(1) A government official or governmental body shall not adopt or enforce any policy\nunder which it directly or indirectly prohibits or discourages the enforcement of any\nlaw, order, or ordinance prohibiting unlawful camping as set forth in KRS 511.110.\n(2) A government official or governmental body shall not directly or indirectly prohibit\nor discourage a peace officer or prosecuting attorney who  is employed by or\notherwise under its direction or control from enforcing any law, order, or ordinance\nprohibiting unlawful camping as set forth in KRS 511.110.\n(3) This section shall not be interpreted or construed to:\n(a) Prohibit a policy that encourages diversion programs or offering of services in\nlieu of citation or arrest;\n(b) Prohibit or otherwise interfere with general orders or decisions that involve\nresource allocation or prioritization made by a governmental official or\ngovernmental body;\n(c) Create any cause of action; or\n(d) Permit a peace officer to disobey an instruction, order, or command from an\nofficer or official within his or her chain of command.\n(4) The Attorney General may bring a civil action in any court of competent\njurisdiction against any government official or governmental body to enjoin it from\nviolating this section.\n(5) The Attorney General may recover reasonable expenses incurred in any civil action\nbrought under this section, including court costs, reasonable attorney's fee s,\ninvestigative costs, witness fees, and deposition costs.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55452","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:20Z","sha256":"f3a1f04bbbc141b42569aa86ec3deb96de27ee31e374c4f032d3fc44d9894f5d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.145","next":"us-ky/krs-65.150"},"notice":"GroundRules: Original legal text.
