{"data":{"id":"us-ky/krs-65.170","jurisdiction":"us-ky","citation":"KRS 65.170","heading":"Dissolution by referendum.","body":"(1) A district may be dissolved by a referendum as provided in this section.\n(2) Persons seeking dissolution of a district shall submit a petition to the county clerk\nsigned by at least fifty percent (50%) of that class of citizens who may by law\npetition for the creation of the district.\n(3) The petition shall be in substantially the following form: \"The undersigned\n(registered voters, qualified voters, freeholders, or landowners as determined by\nsubsection (2) of this section) living within (name of the distr ict and containing a\nmetes and bounds description of the district) hereby request that the question of the\ndissolution of the district be put to a referendum.\" The petition shall conspicuously\nstate in layman's terms that any legal obligations of the distr ict must be satisfied\nbefore the district can be dissolved and that the citizens of the district shall be\nresponsible for the satisfaction of any such obligations. Signatures on the petition\nshall be dated, the last no later than ninety (90) days after the first.\n(4) If the county clerk determines that the petition is in proper order, he shall certify the\npetition to the fiscal court or consolidated local government. The fiscal court or\nconsolidated local government shall direct that the question be placed before the\nvoters at the next regular election if the petition is certified not later than the second\nTuesday in August preceding the day of the regular election. The fiscal court or\nconsolidated local government shall bear the costs of advertising and pla cing the\nquestion before the voters.\n(5) The county clerk shall advertise the question as provided in KRS Chapter 424 and\nshall prepare the following admonition to the voter: \"The (name of district) may\nhave existing legal obligations that must be satisfie d before the district can be\ndissolved. The citizens of the district shall be responsible for the satisfaction of any\nsuch obligations.\" The question of the dissolution of the district shall be placed\nbefore the voters in substantially the following form: \"The (name of the district and\ncontaining a metes and bounds description of the district) should be dissolved.\" The\nvoter shall vote \"yes\" or \"no.\"\n(6) Registered voters eligible to sign a petition for dissolution as provided by\nsubsection (2) of this section shall be eligible to vote on the question of dissolution.\n(7) In referendums under this section, provision shall be made for those opposing the\ndissolution of the district to have equal representation with the proponents of the\nmeasure in the determina tion of eligibility of voters, and in the observance of\ncanvassing and certifying of the returns.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23355","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:20Z","sha256":"def1cd683f46dcafa0d6fd09b1670b0a5986fac6b418c7f58b27a7c85732aad4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.168","next":"us-ky/krs-65.172"},"notice":"GroundRules: Original legal text.
