{"data":{"id":"us-ky/krs-65.2003","jurisdiction":"us-ky","citation":"KRS 65.2003","heading":"Claims disallowed.","body":"Notwithstanding KRS 65.2001, a local government shall not be liable for injuries or\nlosses resulting from:\n(1) Any claim by an employee of the local government which is covered by the\nKentucky workers' compensation law;\n(2) Any claim in connection with the assessment or collection of taxes;\n(3) Any claim arising from the exercise of judicial, quasi -judicial, legislative or quasi -\nlegislative authority or others, exercise of judgment or discretion vested in the local\ngovernment, which shall include by example, but not be limited to:\n(a) The adoption or failure to adopt any ordinance, resolution, order, regulation,\nor rule;\n(b) The failure to enforce any law;\n(c) The issuance, denial, suspension, revocation of, or failure or refusal to issue,\ndeny, suspend or r evoke any permit, license, certificate, approval, order or\nsimilar authorization;\n(d) The exercise of discretion when in the face of competing demands, the local\ngovernment determines whether and how to utilize or apply existing\nresources; or\n(e) Failure to make an inspection.\nNothing contained in this subsection shall be construed to exempt a local\ngovernment from liability for negligence arising out of acts or omissions of its\nemployees in carrying out their ministerial duties.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23369","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:20Z","sha256":"d0b7f9ea52ef5198581482c1980297471deb6174c96243d6ca4bd8712eff572b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.2002","next":"us-ky/krs-65.2004"},"notice":"GroundRules: Original legal text.
