{"data":{"id":"us-ky/krs-65.243","jurisdiction":"us-ky","citation":"KRS 65.243","heading":"Status and authorities of interlocal agency created by interlocal agreement -","body":"- Interlocal agreement controls if more restrictive than KRS 65.210 to 65.300 --\nStatus and authorities are cumulative -- No statutory power to tax granted to\ninterlocal agency -- Interlocal agency deemed a public agency.\n(1) An interlocal agency created by the interlocal agreement shall constitute an agency\nand instrumentality of the public agencies party to the interlocal agreement for the\npurpose of performing the essential governmental functions and the public purposes\nauthorized by the interlocal agreement.\n(2) Unless restricted, limited, or otherwise conditioned under the terms of the interlocal\nagreement, an interlocal agency is authorized to exercise any powers not in conflict\nwith local, state, or federal law or in conflict with the interlocal agreement that are\nnecessary and convenient to accomplish the purposes for which the interlocal\nagency was created.\n(3) To the extent that any of the provisions of the int erlocal agreement are more\nrestrictive, or limit the powers, privileges, or authority of the interlocal agency that\nare otherwise allowed by KRS 65.210 to 65.300, the provisions of the interlocal\nagreement shall control.\n(4) The status and authorities of a n interlocal agency granted in this section, unless\nlimited by the interlocal agreement, is cumulative and in addition to the powers and\nauthority of an interlocal agency that may otherwise exist and that are granted or\nimplied under any other laws of the Commonwealth to a specific type of public\nbody that may also function as an interlocal agency under KRS 65.210 to 65.300.\n(5) Nothing in this section shall be construed to grant an interlocal agency the ability to\nlevy a tax.\n(6) An interlocal agency creat ed by an interlocal agreement shall be deemed to be a\npublic agency as defined in KRS 61.805 and 61.870, and as such shall be subject to\nKRS 61.800 to 61.850 and 61.870 to 61.884.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50378","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:20Z","sha256":"1b3b5e8092dd461d69d9ca57bb5df066ceaba4ebeb6077ba7e85d6c2b30bc12f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.242","next":"us-ky/krs-65.245"},"notice":"GroundRules: Original legal text.
