{"data":{"id":"us-ky/krs-65.247","jurisdiction":"us-ky","citation":"KRS 65.247","heading":"Municipal interlocal gas utility -- Governing body -- Authority.","body":"(1) (a) In addition to the city government members that form a municipal interlocal\ngas utility, the governing body of a municipal interlocal gas utility shall\ninclude one (1) no nmember ex officio representative of each county and city\ngovernment in the Commonwealth that:\n1. Is served by the municipal interlocal gas utility;\n2. Contains any infrastructure used by the municipal interlocal gas utility\nto provide natural gas utility service;\n3. Contains any easements or rights -of-way used by the municipal\ninterlocal gas utility to provide natural gas utility service; or\n4. Contains any land for which the municipal interlocal gas utility has\nrequested an easement or right -of-way that w ill be used to provide\nnatural gas utility service.\n(b) The county judge/executive of a county described in paragraph (a) of this\nsubsection shall select one (1) county representative for the municipal\ninterlocal gas utility governing body and the mayor of  a city described in\nparagraph (a) of this subsection shall select one (1) city representative.\nRepresentatives selected under this paragraph shall not vote on any matter\nbefore the municipal interlocal gas utility except as provided in paragraph (c)\nof this subsection.\n(c) For any proposed municipal interlocal gas utility action directly impacting an\nunincorporated area of any county represented on the governing body, county\nrepresentatives may, if every county representative on the governing body\nvotes unanimously for the same outcome, cast a single combined vote to be\ncounted with the votes of the member city governments on whether the\nmunicipal interlocal gas utility may undertake the action.\n(2) A municipal interlocal gas utility shall not provide natur al gas utility service to a\nresidential customer except:\n(a) As provided in KRS 278.485, in which case the natural gas utility service\nshall be furnished at rates and minimum monthly charges as determined by\nthe Public Service Commission as required by KRS 278.485(1); and\n(b) A municipal interlocal gas utility may f urnish natural gas to a municipal\nutility that provides natural gas utility service to residential customers.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57962","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:20Z","sha256":"6733139bdd11f5694335fd3fa08559af95da7124a18060e6d027fd1b2f8fc110","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.245","next":"us-ky/krs-65.250"},"notice":"GroundRules: Original legal text.
