{"data":{"id":"us-ky/krs-65.440","jurisdiction":"us-ky","citation":"KRS 65.440","heading":"Local legislative bodies, additional powers.","body":"(1) Local legislative bodies shall have all the powers necessary to carry out the\npurposes and provisions of KRS 65.410 to 65.460, including the following powers\nin addition to others granted by KRS 65.410 to 65.460:\n(a) To borrow funds and make expenditures necessary to carry out the purposes of\nKRS 65.410 to 65.460;\n(b) To advance or accept advances of public funds;\n(c) To apply for, accept and utilize grants and any other assistance from the\nfederal government and any other public or private sources; to g ive such\nsecurity as may be required and to enter and carry out contracts or agreements\nin connection with the assistance; and to include in any contract for assistance\nfrom the federal government such conditions imposed pursuant to federal laws\nas the local legislative body may deem reasonable and appropriate and which\nare not inconsistent with the purposes of KRS 65.410 to 65.460;\n(d) To make and execute contracts and other instruments necessary to the exercise\nof its powers under KRS 65.410 to 65.460;\n(e) In connection with the real property acquired for the purposes of KRS 65.410\nto 65.460, to provide or to arrange or contract for the provision, construction,\nmaintenance, operation or repair by any person or agency, public or private, of\nservices, privileges, works, streets, roads, public utilities, or other facilities or\nstructures that may be necessary to the provision, preservation, maintenance,\nand management of the property as open space land;\n(f) To insure or provide for the insurance of any real  or personal property or\noperations of the public body against any risks or hazards, including the power\nto pay premiums on the insurance;\n(g) To demolish or dispose of any structures or facilities which may be\ndetrimental to or inconsistent with the use of real property as open space land;\nand\n(h) To exercise any or all of its functions and powers under KRS 65.410 to 65.460\njointly or cooperatively with one or more public bodies of this state, and to\nenter into agreements for joint or cooperative action.\n(2) For the purposes of KRS 65.410 to 65.460 the local legislative bodies may:\n(a) Appropriate funds;\n(b) Issue and sell their revenue bonds and general obligation bonds in the manner\nand within the limitations prescribed by the applicable laws of the\nCommonwealth; and\n(c) Exercise their powers under KRS 65.410 to 65.460 through a board or\ncommission, or through such office or officers as the local legislative bodies\nby resolution determine.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23403","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:21Z","sha256":"8e9005c1e8ceb91451a5f8331672f83f4f3d7b63a7cd9a3e0b6ac8e20fd5c6b8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.430","next":"us-ky/krs-65.450"},"notice":"GroundRules: Original legal text.
