{"data":{"id":"us-ky/krs-65.466","jurisdiction":"us-ky","citation":"KRS 65.466","heading":"Requirements for acceptance.","body":"A scenic easement shall not be accepted by a city, county, urban -county, or consolidated\nlocal government, unless the governing body, by resolution finds:\n(1) That the preservation of the character of the land is consistent with the plan of the\ncity, count y, consolidated local government, or urban -county, where such plan\nexists; and\n(2) That the preservation of the character of the land is in the best interest of the state,\ncounty, city, consolidated local government, or urban -county, is important to the\npublic for the enjoyment of scenic beauty, and will serve the public interest in a\nmanner recited in the resolution and consistent with the purposes of KRS 65.462 to\n65.480.\n(3) The local legislative body may consider these factors:\n(a) It is likely that at some time the public may acquire the land for a park or other\npublic use;\n(b) The land is unimproved and has scenic value to the public as viewed from a\npublic highway or from public or private buildings;\n(c) The retention of the land as open space will ad d to the amenities of living in\nadjoining or neighboring urbanized areas;\n(d) The land lies in an area which in the public interest should remain rural in\ncharacter and the retention of the land as open space will help preserve the\nrural character of the area;\n(e) It is in the public interest that the land remain in its natural state, including the\ntrees and other natural growth, as a means of preventing floods or soil erosion\nor because of its value as watershed;\n(f) The land lies within an established scenic highway corridor;\n(g) The land is valuable to the public as a wildlife preserve or sanctuary and the\ninstrument contains appropriate covenants to that end; or\n(h) The land has historic significance or contains a building of either historic or\narchitectural importance.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23408","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:21Z","sha256":"46b209129f1555a8eaf280dd98f7fa5888eb7c518116281af3fbed6c553851c5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.464","next":"us-ky/krs-65.468"},"notice":"GroundRules: Original legal text.
