{"data":{"id":"us-ky/krs-65.470","jurisdiction":"us-ky","citation":"KRS 65.470","heading":"Construction in violation of easement prohibited -- Injunctive relief.","body":"(1) From and after the time when a scenic easement has been acquired by the local\nlegislative body and its acceptance endorsed thereon, no building permit shall be\nissued for any structure which would violate the easement and the local legislative\nbody shall s eek by appropriate proceedings an injunction against any threatened\nconstruction or other development or activity on the land which would violate the\neasement and shall seek a mandatory injunction requiring the removal of any\nstructure erected in violation  of the easement and the restoration of the land to its\noriginal character insofar as possible.\n(2) In the event the local legislative body fails to seek an injunction against any\nthreatened construction or other development or activity on the land which would\nviolate the easement or to seek a mandatory injunction requiring the removal of any\nstructure erected in violation of the easement or the restoration of the land to its\noriginal character insofar as possible, or if the local legislative body should\nconstruct any structure or development or conduct or permit any activity in violation\nof the easement, any resident of the jurisdiction which has acquired the easement\nmay, by appropriate proceedings, seek such an injunction.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23410","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:21Z","sha256":"51bde6261cb16d16f9d0ba19a9b68aeec5ae6b0d7d79da221fabcfedf407df2b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.468","next":"us-ky/krs-65.472"},"notice":"GroundRules: Original legal text.
