{"data":{"id":"us-ky/krs-65.760","jurisdiction":"us-ky","citation":"KRS 65.760","heading":"Establishment of 911 emergency telephone service by local government --","body":"Sources and disposition of revenues -- Funding.\n(1) Any local government may establish 911 emergency service upon approval of the\ngoverning body of the city, county, or urban -county government and may adopt\nregulations concerning the provision of this service by ordinance.\n(2) Any local government, or any combination thereof, may with the approval of their\ngoverning bodies enter into an interlocal cooperation agreement creating a joint 911\nemergency service.\n(3) (a) The funds required by a local government to establish and operate 911\nemergency service, or to participate in joint service with other local\ngovernments, may be obtained through the levy of any special tax, license, or\nfee not in conflict with the Constitution and statutes of this state. The special\ntax, license, or fee may include a subscriber charge for 911 emergency service\nthat shall be levied on an individual exchange -line basis, limited to a\nmaximum of twenty -five (25) exchange lines per account per government\nentity.\n(b) Any private commercial telephone service or owner of a dispersed private\ntelephone system (DPTS) that provides local and 911 emergency service to\nsubscribers for compensation shall collect and remi t the subscriber charge to\nthe local government on the same basis as the primary local exchange carrier,\nexcept that this requirement shall not apply to a state agency that currently\nmaintains an independent 911 system with its own public safety answering\npoint.\n(c) Any provider of interconnected VoIP local and 911 emergency services to\nsubscribers for compensation shall collect and remit any special tax, license,\nor fee levied under paragraph (a) of this subsection to the local government,\nexcept that the special tax, license, or fee levied under paragraph (a) of this\nsubsection shall not apply to a commercial mobile radio service subject to a\nfee imposed under KRS 65.7629 or 65.7634.\n(4) All revenues raised from any special tax, license, or fee levied unde r subsection (3)\nof this section shall be expended only as provided in this subsection and only to the\nextent that the expenditure is directly attributable to the establishment, operation, or\nmaintenance of a PSAP, the delivery of 911 emergency services, or the provision of\nwireless enhanced 911 services, as follows:\n(a) The hiring of personnel;\n(b) The following costs for employees:\n1. Salaries;\n2. Fringe benefits;\n3. MSAG coordination;\n4. Uniforms; and\n5. Addressing and database development and management;\n(c) Facility costs for the following expenses:\n1. Capital improvements for construction, remodeling, or expansion;\n2. Lease or rental payments;\n3. Utilities;\n4. Heating and air conditioning;\n5. Fire suppression systems;\n6. Security systems;\n7. Cleaning and maintenance;\n8. Emergency power and uninterruptable power equipment;\n9. Insurance;\n10. Office supplies;\n11. Printing and copying services; and\n12. Furniture;\n(d) Training and memberships in professional associations, including:\n1. Vendor-provided training;\n2. Conferences;\n3. Necessary travel and lodging;\n4. On-the-job training; and\n5. Memberships in 911-related associations;\n(e) Costs for the following equipment shall be allowed to the extent its function is\ndirectly attributable to the provision of 911 emergency services, whether on\nthe premises or remotely located:\n1. 911 controllers, equipment, or software;\n2. 911 trunks or administrative lines for the 911 center;\n3. Remote 911 hardware or modems;\n4. ACD systems or other call management facilities and software;\n5. Call-time stamping or other clock functions;\n6. Computer workstations;\n7. Telephone and related services to support the receipt of 911 contact\nfrom the deaf and hard of hearing community;\n8. Voice and data recording systems;\n9. Radio systems, including consoles and any fixed radio asset that is not\nmobile or portable and that is used for 911 and emergency response;\n10. CAD, GIS mapping, paging, mobile data, LINK/NCIC, or AVL systems\nand associated databases;\n11. Network connectivity;\n12. Software licenses; and\n13. Maintenance or service agreements for equipment or software listed in\nthis subsection;\n(f) Vehicle costs for the following, either as reimbursement to an employee for\nthe use of a private vehicle or direct costs for a vehicle assigned to the agency:\n1. MSAG development and maintenance;\n2. GIS data development, verification, and testing; and\n3. Public education;\n(g) Costs for the following professional services:\n1. Legal;\n2. Architectural;\n3. Auditing; and\n4. Consultation; and\n(h) Costs for public education regarding the proper use of 911 emergency\nservices.\n(5) A local government shall not use revenues from any special tax, license, or fee\nlevied under subsection (3) of this section for personnel costs, facility costs, training\nand membership costs, equipment costs, vehicle costs, professional services costs,\npublic education costs, nor any of the following costs, unless the expense is directly\nattributable to the delivery of 911 emergency services:\n(a) Personnel costs for the following personnel, unless directly functioning as\nPSAP staff:\n1. Law enforcement;\n2. Emergency medical services personnel;\n3. Fire protection personnel;\n4. Emergency management staff; and\n5. Shared support or technical staff;\n(b) Facility costs for the following purposes and facilities, except for that portion\nused for the delivery of 911 emergency services:\n1. Capital and furnishing costs for facilities whose primary purpose is not\nthe delivery of 911 emergency services;\n2. Facilities primarily intended for use by police, fire, emergency medical\nservices, or other emergency management personnel; and\n3. Facilities providing general offices for local government operations;\n(c) Training and membership costs for the following purposes:\n1. Costs for training for staff not directly involved in the delivery of 911\nemergency services or courses whose content is not intended to increase\nthe knowledge, skills, and abilities of 911 perso nnel with regard to\ndelivery of 911 emergency services; and\n2. Costs for memberships in organizations or associations whose primary\npurpose is not public safety communications or the delivery of 911\nemergency services;\n(d) The following hardware, software, or peripheral costs:\n1. Law enforcement, fire protection, emergency medical services, or jail\nrecord management systems;\n2. Word processing and other general computer applications;\n3. GIS applications providing data layers not needed for the location of\nemergency calls or other general mapping and locations services for\ngovernment operations;\n4. Court information systems;\n5. Field equipment used outside of the PSAP by emergency responders or\nother government personnel for radio, paging, mobile data, LINK/NCIC,\nACD, or AVL systems;\n6. Internet connectivity for an application listed in this subsection;\n7. A maintenance or service agreement for an application listed in this\nsubsection; and\n8. A software license for an application listed in this subsection;\n(e) The cost of an emergency response or other government vehicle;\n(f) Costs for professional services; and\n(g) Costs for public education.\n(6) The governing body may apply for and accept federal moneys and may accept\ncontributions and donations from any sour ce for the purpose of funding 911\nemergency service.\n(7) Nothing in this section shall preclude other means of establishing or funding a 911\nemergency service within any local area or exchange, nor require the operation of\nsuch service by any local government.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45284","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:22Z","sha256":"0824179adbdb31f471466b3f42d323e39a3581cbedb163ff2ec44254b27d88ed","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.755","next":"us-ky/krs-65.7621"},"notice":"GroundRules: Original legal text.
