{"data":{"id":"us-ky/krs-65.7621","jurisdiction":"us-ky","citation":"KRS 65.7621","heading":"Definitions for KRS 65.7621 to 65.7643.","body":"As used in KRS 65.7621 to 65.7643, unless the context requires otherwise:\n(1) \"Administrator\" means the person who serves as the state 911 coordinator, the\nexecutive director of the Kentucky 911 Services Board, and the state administrator\nof CMRS emergency telecommunications under KRS 65.7625;\n(2) \"Automatic location identification\", or \"ALI\" means a feature by which the location\nor estimated location of the calling party is made available to a PSAP in accordance\nwith applicable FCC rules and regulations;\n(3) \"Automatic number identification\", or \"ANI\" means a feature that allows for the\nautomatic display of the 911 caller's ten -digit number, or equivalent, in accordance\nwith applicable FCC rules and regulations;\n(4) \"Board\" means the Kentucky 911 Services Board;\n(5) \"CMRS\" means commercial mobile radio service under Sections 3(27) and 332(d)\nof the Federal Telecommunications Act of 1996, 47 U.S.C. secs. 151 et seq., and\nthe Omnibus Budget Reconciliation Act of 1993, as it existed on August 10, 1993.\nThe term  includes the term \"wireless\" and service provided by any wireless real\ntime two -way voice communication device, including radio -telephone\ncommunications used in cellular telephone service, personal communications\nservice, and the functional or competitive  equivalent of a radio -telephone\ncommunications line used in cellular telephone service, a personal communications\nservice, or a network radio access line;\n(6) \"CMRS connection\" means a mobile handset telephone number assigned to a\nCMRS customer;\n(7) \"CMRS customer\" means an end user to whom a mobile handset telephone number\nis assigned and to whom CMRS is provided in return for compensation;\n(8) \"CMRS Fund\" means the commercial mobile radio service emergency\ntelecommunications fund;\n(9) \"CMRS provider\" mea ns a person or entity who provides CMRS to an end user.\nThe term includes both facilities-based resellers and nonfacilities-based resellers;\n(10) \"CMRS service charges\" means the CMRS postpaid service charge, the CMRS\nprepaid service charge, and the CMRS s ervice charge fee levied under KRS\n65.7636;\n(11) \"CMRS postpaid service charge\" means the CMRS emergency telephone service\ncharge fee levied under KRS 65.7629(3) and collected under KRS 65.7635;\n(12) \"CMRS prepaid service charge\" means the fee imposed on p repaid wireless\ntelecommunications service under KRS 65.7634 and collected under KRS 142.100\nto 142.135;\n(13) \"Core services\" or \"next generation core services\":\n(a) Means the base set of services needed to process a 911 service request within\na next generation 911 environment;\n(b) Is limited to the functional elements essential to routing emergency calls based\non location information through a managed emergency servic es Internet\nprotocol network infrastructure; and\n(c) Includes only the services, and not the network on which they operate;\n(14) \"FCC order\" means the Order of the Federal Communications Commission, FCC\nDocket No. 94 -102, adopted effective October 1, 1996,  including any subsequent\namendments or modifications thereof;\n(15) \"Local exchange carrier\" or \"LEC\" means any person or entity who is authorized to\nprovide telephone exchange service or exchange access in the Commonwealth;\n(16) \"Local government\" means a ny city, county, charter county, or urban -county\ngovernment of the Commonwealth, or any other governmental entity maintaining a\nPSAP;\n(17) \"Mobile telephone handset telephone number\" means the ten (10) digit number\nassigned to a CMRS connection;\n(18) \"Next generation 911\" means a 911 system where any device capable of making a\n911 emergency request uses digital technology through managed emergency\nservices Internet protocol networks composed of functional elements and databases\nthat replicate enhanced 911 f eatures and functions while providing additional\nmultimedia capabilities for the PSAP. \"Next generation 911\" includes any\ntechnology, functions, capabilities, best practices, or processes, either currently\nexisting or later developed, that will be used dur ing and after the transition of the\ndelivery of 911 services from analog to digital technology;\n(19) \"Prepaid wireless telecommunications service\" means a wireless\ntelecommunications service that, if purchased, is required to be paid for in advance\nand is either sold in predetermined units, dollars, or time which decline with use in\na known amount, or is sold for unlimited use during a predetermined period of time;\n\"Prepaid wireless telecommunications service\" includes service provided by prepaid\nwireless providers approved as eligible telecommunications companies by the\nKentucky Public Service Commission to participate in the wireless low -income\nLifeline program;\n(20) \"Prepaid wireless telecommunications service provider\" means a person or entity\nthat prov ides prepaid wireless telecommunications service as authorized by a\nlicense issued by the FCC;\n(21) \"Proprietary information\" means information, including customer lists and other\nrelated information, technology descriptions, technical information, or trade secrets;\n(22) \"Pseudo-automatic number identification\" means a wireless enhanced 911 service\ncapability that enables the automatic display of the number of the cell site or cell\nface;\n(23) \"Public safety answering point\" or \"PSAP\" means a communications facility that is\nassigned the responsibility to receive 911 calls originating in a given area and, as\nappropriate, to dispatch public safety services or to extend, transfer, or relay 911\ncalls to appropriate public safety agencies;\n(24) \"Purchaser\" means a  person who purchases prepaid wireless telecommunications\nservice in a retail transaction;\n(25) \"Retail transaction\" means the purchase of prepaid wireless telecommunications\nservice from a retailer for any purpose other than resale;\n(26) \"Retailer\" means a person who sells prepaid wireless telecommunications service to\nany person for a purpose other than resale;\n(27) \"Service connection\" means the transmission, conveyance, or routing of voice, data,\nvideo, text, or any other information signal of the purch aser's choosing by any\nmedium or method now in existence or later devised with the ability to directly\nconnect the user to 911 emergency services;\n(28) \"Service supplier\" means a person or entity who provides local exchange telephone\nservice to a telephone subscriber;\n(29) \"Tier III CMRS provider\" means a non-nationwide commercial mobile radio service\nprovider with no more than five hundred thousand (500,000) subscribers as of\nDecember 31, 2001; and\n(30) \"Wireless enhanced 911 system,\" \"wireless E911 system ,\" \"wireless enhanced 911\nservice,\" or \"wireless E911 service\" means an emergency telephone system that\nprovides the end user of the CMRS connection with wireless 911 service and, in\naddition, directs 911 calls to appropriate public safety answering points based on the\ngeographical location from which the call originated and provides the capability for\nautomatic number identification and automatic location identification features in\naccordance with the requirements of the FCC order.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53224","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:22Z","sha256":"849aa1e39264f4bb7bacc7bd3640dc3050e0fa38a047d150c424b51a6d7a975d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.760","next":"us-ky/krs-65.7623"},"notice":"GroundRules: Original legal text.
