{"data":{"id":"us-ky/krs-65.7630","jurisdiction":"us-ky","citation":"KRS 65.7630","heading":"Gathering and reporting information regarding 911 emergency","body":"communications funding and costs -- Annual report to board by agencies and\nproviders -- Administrative regulations -- Information subject to disclosure\nunder Open Records Act and information subject to confidentiality -- Report\nto Legislative Research Commission.\n(1) The board shall gather and report data and information regarding 911 emergency\ncommunications funding procedures and costs on or before November 1 of each\nyear.\n(2) The board sh all determine the information it needs to evaluate 911 funding,\ncollection of the CMRS service charges, and expenditures, and each local\ngovernment, state governmental agency, wireless or wireline provider of technology\ncapable of transmitting voice or tex t traffic for an emergency 911 request to a\nPSAP, and/or private citizen in possession of that information shall provide the\ninformation to the board within the time frames established by the board. The board\nmay hire a consultant to gather and analyze the information required by this section.\n(3) Each local governmental agency and state governmental agency having jurisdiction\nover one (1) or more public safety answering points (PSAPs) shall provide at least\nthe following information to the board each fiscal year:\n(a) The amount of revenue available or budgeted for 911 services from the\nfollowing sources:\n1. The state general fund;\n2. CMRS funds received through the distribution formula under KRS\n65.7631;\n3. City and county general funds\n4. CMRS grant funds\n5. Other grant funds and their sources; and\n6. Any other funds received for 911 service and their sources; and\n(b) How the revenue described in this paragraph was spent by the PSAPs.\n(4) Each CMRS provider shall submit at least the following to the board:\n(a) One (1) annual report each calendar year of the total number of active CMRS\nconnections in each zip code within Kentucky served by the provider for each\nmonth during the year. The report shall be in the form and manner prescribed\nby the board and shall be submitted no later than thirty (30) days after the end\nof each year. Each CMRS provider shall include in its report separate counts\nof the numbers of active CMRS connections attributable to prepaid customers,\npostpaid customers, and wireless low-income Lifeline customers served by the\nCMRS provider for each month. For the purposes of this subsection, \"active\nCMRS connection\" means all CMRS connections that have an account\nbalance of units of time or dollars greater than zero on any day of the month\nand includes every Lifeline end user for whom the CMRS provider received\nreimbursement from the universal service fund during the month under the\nwireless low-income Lifeline program; and\n(b) Upon request of the board, any other information needed to evaluate CMRS\nservice charge remittances to the board.\n(5) Each local governmental agency, state governmental agency, or wireless or wireline\nprovider of technology capable of transmitting voice traffic for an emergency 911\nrequest to a PSAP that fails to provide t he information required by this section shall\nnot be eligible to receive distributions of state funds from the CMRS Board.\n(6) The CMRS Board shall promulgate administrative regulations in accordance with\nKRS Chapter 13A to establish annual reporting requi rements so that the board has\nthe information needed to monitor the use of 911 funds and the rate of the 911\nservice charge.\n(7) All information received by the CMRS Board pursuant to this section shall be\nsubject to disclosure under KRS 61.870 to 61.884. Proprietary information given to\nthe board by any wireless or wireline provider of technology capable of transmitting\nvoice or text traffic for an emergency 911 request to a PSAP pursuant to this section\nshall be subject to the same confidentiality as prov ided for proprietary information\nunder KRS 65.7639 and shall only be released or published in aggregate amounts\nwhich do not identify or allow identification of numbers of CMRS customers or\nrevenues attributable to an individual CMRS provider.\n(8) The CMRS  Board shall ensure that the Legislative Research Commission has\naccess to all data collected under this section and shall report this information to the\nLegislative Research Commission's Interim Joint Committee on Veterans, Military\nAffairs, and Public Protection by November 1 of each year.
