{"data":{"id":"us-ky/krs-65.7640","jurisdiction":"us-ky","citation":"KRS 65.7640","heading":"Mobile telecommunications services -- Adoption of federal provisions --","body":"Notification of service provider about errors -- Correction and refund --\nExhaustion of remedies.\nAs it relates, under KRS 65.7621 to 65.7643, to mobile telecommunications service s as\ndefined in 4 U.S.C. sec. 124:\n(1) The provisions of 4 U.S.C. secs. 116 to 126 are hereby adopted and incorporated by\nreference.\n(2) If a customer believes that a tax, charge, fee, or assignment of place of primary use\nor taxing jurisdiction on a bill is incorrect, the customer shall notify the service\nprovider about the alleged error in writing. This notification shall include the street\naddress for the customer's place of primary use, the account name and number for\nwhich the customer seeks a correcti on, a description of the alleged error, and any\nother information that the service provider reasonably requires. Within sixty (60)\ndays of receiving the customer's notification, the service provider shall either correct\nthe error and refund or credit all t axes, charges, and fees incorrectly charged to the\ncustomer within four (4) years of the customer's notification, or explain to the\ncustomer in writing how the bill was correct and why a refund or credit will not be\nmade.\n(3) A customer shall not have a ca use of action against a service provider for any\nerroneously collected taxes, charges, or fees until the customer has exhausted the\nprocedure set forth in subsection (2) of this section.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=23510","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:22Z","sha256":"39b4e63238a80bb19835e13cde5773937ebd5efa367902b342e4098b1a5741b6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.7639","next":"us-ky/krs-65.7641"},"notice":"GroundRules: Original legal text.
