{"data":{"id":"us-ky/krs-65.870","jurisdiction":"us-ky","citation":"KRS 65.870","heading":"Local firearms control ordinances prohibited -- Exemption from immunity -","body":"- Declaratory and injunctive relief.\n(1) No existing or future city, county, urban -county government, charter county,\nconsolidated local government, unified local government, sp ecial district, local or\nregional public or quasi -public agency, board, commission, department, public\ncorporation, or any person acting under the authority of any of these organizations\nmay occupy any part of the field of regulation of the manufacture, sa le, purchase,\ntaxation, transfer, ownership, possession, carrying, storage, or transportation of\nfirearms, ammunition, components of firearms, components of ammunition,\nfirearms accessories, or combination thereof.\n(2) Any existing or future ordinance, exe cutive order, administrative regulation, policy,\nprocedure, rule, or any other form of executive or legislative action in violation of\nthis section or the spirit thereof is hereby declared null, void, and unenforceable.\n(3) Any person or organization speci fied in subsection (1) of this section shall repeal,\nrescind, or amend to conform, any ordinance, administrative regulation, executive\norder, policy, procedure, rule, or other form of executive or legislative action in\nviolation of this section or the spir it thereof within six (6) months after July 12,\n2012.\n(4) Pursuant to Section 231 of the Constitution of Kentucky, insofar as any person or\norganization specified in subsection (1) of this section is considered an agent of the\nCommonwealth, it is the inten t of the General Assembly to exempt them from any\nimmunity provided in Section 231 of the Constitution of Kentucky to the extent\nprovided in this section. A person or an organization whose membership is\nadversely affected by any ordinance, administrative r egulation, executive order,\npolicy, procedure, rule, or any other form of executive or legislative action\npromulgated or caused to be enforced in violation of this section or the spirit thereof\nmay file suit against any person or organization specified in subsection (1) of this\nsection in any court of this state having jurisdiction over any defendant to the suit\nfor declaratory and injunctive relief. A court shall award the prevailing party in any\nsuch suit:\n(a) Reasonable attorney's fees and costs in accor dance with the laws of this state;\nand\n(b) Expert witness fees and expenses.\n(5) If any person or organization specified in subsection (1) of this section violates this\nsection or the spirit thereof, the court shall declare the improper ordinance,\nadministrative regulation, executive order, policy, procedure, rule, or other form of\nexecutive or legislative action specified in subsection (1) of this section null, void,\nand unenforceable, and issue a permanent injunction against the person or\norganization specified in subsection (1) of this section prohibiting the enforcement\nof such ordinance, administrative regulation, executive order, policy, procedure,\nrule, or any other form of executive or legislative action specified in subsection (1)\nof this section.\n(6) A violation of this section by a public servant shall be a violation of either KRS\n522.020 or 522.030, depending on the circumstances of the violation.\n(7) The provisions of this section shall not apply where a statute specifically authorizes\nor directs an agency or person specified in subsection (1) of this section to regulate\na subject specified in subsection (1) of this section.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40556","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:23Z","sha256":"a2f28e3dbc994590ca47eee59b55123ab07ba8d18c84b3429dd826365702e6bd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.830","next":"us-ky/krs-65.871"},"notice":"GroundRules: Original legal text.
