{"data":{"id":"us-ky/krs-65.879","jurisdiction":"us-ky","citation":"KRS 65.879","heading":"Prohibition against local ordinances specifically applicable to residential","body":"care facilities for persons with a disability -- Information to be provided by\nCabinet for Health and Family Services -- Facilities not exempted from general\napplication ordinances.\n(1) As used in this section:\n(a) \"Cabinet\" means the Cabinet for Health and Family Services;\n(b) \"Local government\" means a city, county, charter county, urban -county\ngovernment, consolidated local government, or unified local government;\n(c) \"Persons with a disability\" has the same meaning as in KRS 100.982; and\n(d) \"Residential care facility\" means a residence, including a group home or\nstaffed residence, operated and maintained by:\n1. A private agency receiving state or federal funds; or\n2. A government agency;\nthat provides services in a homelike setting for persons with a disability.\n(2) A local government shall not adopt or enforce any licensing or other requirements\nspecifically applicable to residential care facilities providing services for  persons\nwith a disability beyond those required by statutes or administrative regulations of\nthe Commonwealth of Kentucky or the federal government.\n(3) (a) A local government may adopt a resolution by its legislative body requesting\nthe cabinet to provid e information on each residential care facility within the\nrequesting local government's boundaries. The cabinet shall provide\ninformation to the local government within thirty (30) days of the receipt of\nthe resolution requesting this information. The inf ormation provided by the\ncabinet shall be limited to:\n1. The physical location of the residential care facility or facilities; and\n2. The name and contact information for the individual or organization\nprimarily responsible for the oversight of the facility or facilities.\n(b) Once a resolution has been filed by a local government, the cabinet shall:\n1. Provide that local government updated information if:\na. The number of residential care facilities within the jurisdiction\nchanges;\nb. The physical location changes; or\nc. The name and contact information for the individual or\norganization primarily responsible for the oversight changes; or\n2. Provide an annual update of the information provided in this subsection,\nin the event that the provisions of subparagraph 1. of this paragraph do\nnot occur.\n(c) The information provided in this subsection shall only be for the use of the\nlocal governme nt's law enforcement agencies, fire protection services, or\nemergency service providers. The information provided by the cabinet shall\nnot be subject to the provisions of KRS 61.872 to 61.884. This exemption\napplies solely to the local government receiving the information.\n(4) This section shall not be construed to exempt residential care facilities from\ncompliance with local government ordinances that apply generally within the\njurisdiction, including but not limited to business licensing requirements,\noccupational license taxes, nuisance and property maintenance codes, public and\nfire safety ordinances, health and sanitation ordinances, zoning requirements as\nprovided under KRS 100.984, or any other type of local ordinance of general\napplication.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40221","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:23Z","sha256":"c6b3735c44df407c8d1073e972ae88a2bbd9e758259cd31d716d9a9165e261a6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.877","next":"us-ky/krs-65.8801"},"notice":"GroundRules: Original legal text.
