{"data":{"id":"us-ky/krs-65.8825","jurisdiction":"us-ky","citation":"KRS 65.8825","heading":"Enforcement proceedings -- Procedure.","body":"(1) Enforcement proceedings before a code enforcement board or hearing officer\nshall be initiated by the issuance of a citation by a code enforcement officer.\n(2) When  a code  enforcement officer, based  upon  personal observation or\ninvestigation, has reasonable cause to believe that a person has committed a\nviolation of a local government ordinance, the officer is authorized to issue a\ncitation by:\n(a) Personal service to the alleged violator;\n(b) Leaving a copy of the citation with any person eighteen (18) years of age\nor older who  is on the premises, if the alleged violator is not on the\npremises at the time the citation is issued;\n(c) Mailing a copy of the citation by regular first-class mail to the last known\nrecorded mailing address of the alleged violator; or\n(d) If, in the exercise of reasonable diligence, the issuance of a citation using\nthe methods set out in paragraphs (a) to (c) of this subsection is not\npossible, then the citation is properly served by posting a copy of the\ncitation in a conspicuous place on the premises.\n(3) When  authorized by ordinance, a code enforcement officer may, in lieu of\nimmediately issuing a citation, give notice that a violation shall be remedied\nwithin a specified period of time. If the person to whom  the notice is given fails\nor  refuses to remedy  the violation within the time specified, the code\nenforcement officer is authorized to issue a citation.\n(4) The  citation issued by the code enforcement officer shall be in a form\nprescribed by the local government and shall contain, in addition to any other\ninformation required by ordinance or rule of the board:\n(a) The date and time of issuance;\n(b) The name and address of the person to whom  the citation is issued;\n(c) The date and time the offense was committed;\n(d) The facts constituting the offense;\n(e) The section of the code or the number of the ordinance violated;\n(f) The name of the code enforcement officer;\n(g) The civil fine that will be imposed for the violation if the person does not\ncontest the citation if the local government has elected to use the\nalternative authorized under KRS 65.8808(2)(b);\n(h) The  maximum  civil fine that may  be imposed if the person elects to\ncontest the citation;\n(i) The procedure for the person to follow in order to pay the civil fine or to\ncontest the citation; and\n(j) A  statement that if the person fails to pay the civil fine set forth in the\ncitation or contest the citation, within the time allowed, the person shall be\ndeemed  to have  waived the right to a  hearing before the code\nenforcement board or hearing officer to contest the citation and that the\ndetermination that a violation was  committed shall be final, and the\nalleged violator shall be deemed  to have waived the right to appeal the\nfinal order to District Court.\n(5) After issuing a citation to an alleged violator, the code enforcement officer shall\nnotify the code  enforcement board  by  delivering the citation to the\nadministrative official designated by ordinance or by the board. The code\nenforcement officer, hearing officer, or code enforcement board may also elect\nto provide notice of the issuance of the citation to any lienholder with an\ninterest in the subject premises.\n(6) When  a citation is issued, the person to whom  the citation is issued shall\nrespond to the citation within seven (7) days of the date the citation is issued\nby either paying the civil fine set forth in the citation or requesting, in writing, a\nhearing to contest the citation. If the person fails to respond to the citation\nwithin seven (7) days, the person shall be deemed to have waived the right to a\nhearing to contest the citation and the determination that a violation was\ncommitted shall be considered final. In this event, the citation, as issued, shall\nbe  deemed  a final order determining that the violation was committed and\nimposing the civil fine set forth in the citation, and the alleged violator shall be\ndeemed  to have waived the right to appeal the final order to District Court.\nNotice of the final order shall be provided to the cited violator by:\n(a) Regular first-class mail;\n(b) Certified mail, return receipt requested;\n(c) Personal delivery; or\n(d) Leaving a copy of the order at that person's usual place of residence with\nany individual residing therein who is eighteen (18) years of age or older\nand who is informed of the contents of the order.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46455","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:23Z","sha256":"19a60b8e915c1561de31350945e83da9fb604916d9fa36a22e8850a9a39ca4d5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.8823","next":"us-ky/krs-65.8828"},"notice":"GroundRules: Original legal text.
