{"data":{"id":"us-ky/krs-65.8901","jurisdiction":"us-ky","citation":"KRS 65.8901","heading":"Legislative findings -- Statutory authority for regional wastewater","body":"commission.\n(1) The General Assembly finds that regionalization of utility services can benefit\nKentuckians by sharing the capital and operating costs of facilities among many\nusers w hile protecting and enhancing the water quality of the Commonwealth's\nwatersheds, creeks, lakes, and rivers. The General Assembly additionally finds and\ndeclares that:\n(a) Continued economic growth in the Commonwealth is dependent upon the\nexpansion of infrastructure to promote industrial, commercial, and residential\ndevelopment;\n(b) Industrial, commercial, institutional, and residential development must be\nundertaken in a manner consistent with applicable planning, and in a manner\nthat safeguards the waters of the Commonwealth from pollution;\n(c) The challenges of improving and safeguarding the quality of the\nCommonwealth's watersheds, creeks, streams, lakes, and rivers through\nimprovements in wastewater infrastructure and expanded wastewater\ntreatment capacity favor a cooperative, regional approach;\n(d) The Base Realignment and Closure (BRAC) Commission has realigned the\nmission at Fort Knox, a one hundred nine thousand (109,000) acre military\nreservation located in three (3) counties of the Commonwealth, r esulting in\nsignificant economic expansion in the region encompassing the post;\n(e) The ongoing regional economic expansion in the Fort Knox area of Hardin,\nBullitt, and Meade counties resulting from BRAC, and the industrial,\ncommercial and residential dev elopment throughout the Salt River Basin,\nincluding expansion in the adjacent counties of Oldham and Jefferson, provide\na unique opportunity to illustrate the advisability of adopting a regionally\nintegrated approach to wastewater management as a cost -effective and more\naffordable way to preserve Kentucky's water resources; and\n(f) It is, therefore, the intent of the General Assembly to authorize the creation of\na regional wastewater commission in accordance with KRS 65.8901 to\n65.8923, within the counties of Bullitt, Hardin, Jefferson, Meade, and\nOldham, or portions of those counties, for the purposes of preserving water\nquality and developing infrastructure in the Salt River Basin sufficient to\npromote and sustain industrial, commercial, and residential development.\n(2) KRS 65.8901 to 65.8923 shall constitute full and complete authority for the creation\nof a regional wastewater commission and for carrying out the powers and duties of\nthe commission.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39874","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:23Z","sha256":"33faee937d2d4cce292f075f42f37cdf0dfc5dd854b34ccbbbc0197874e6436f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.8840","next":"us-ky/krs-65.8903"},"notice":"GroundRules: Original legal text.
