{"data":{"id":"us-ky/krs-65.8905","jurisdiction":"us-ky","citation":"KRS 65.8905","heading":"Procedure for forming regional wastewater commission.","body":"(1) Any two (2) or more member entities owning wastewater systems may jointly:\n(a) Acquire and construct wastewater collection, transportation, and treatment\nfacilities;\n(b) Operate and manage those facilities; and\n(c) Improve and extend those facilities in any manner permitted under law.\n(2) The governing body of a member entity owning a wastewater system that wants to\nform a regional wastewater commission shall adopt a resolution or ordinance\nelecting to participate with other member entities to perform any o f the functions\nauthorized under subsection (1) of this section.\n(3) Upon the adoption of an ordinance or resolution by the governing body of each\nmember entity or a decision by a local, state, or federal agency owning a wastewater\nsystem to participate in  a commission, a certified copy of each member entity's\naction shall be filed with the organizing official.\n(4) Prior to the adoption by the governing body of any member entity of a resolution or\nordinance proposing participation in a commission, that gove rning body shall\npublish notice in accordance with KRS Chapter 424 and shall set a date for a public\nhearing regarding the creation of the commission and shall give at least thirty (30)\ndays' prior notice of the hearing. The notice shall include, at a minimum:\n(a) An explanation of the scope of the geographic area proposed to be served by a\ncommission; and\n(b) A description of the anticipated benefits to the residents in the geographic area\nserved by the member entity of membership by that entity in a commission.\nA resident, sewer customer, or citizen of the Commonwealth affected by a member\nentity proposing to establish a commission may submit written or oral comments\nand objections to the member entity, which shall provide a written statement of\nconsideration of comments received.\n(5) The member entity shall enter an order of decision along with specific findings for\nthe decision. The organizing official among the member entities seeking to form a\ncommission shall establish the commission, designating it as a \"regional wastewater\ncommission,\" if, after the public hearing and consideration of all comments and\nobjections received, those member entities have adopted a resolution or ordinance,\nas appropriate, finding that:\n(a) The establishment of a commission is in the furtherance of the public health,\nconvenience, and benefit to the customers of the member entities proposing\nthe creation of the commission; and\n(b) The establishment of a commission can reasonably be expected to result in the\nimprovement of the environment over that which would occur in the absence\nof the formation of the commission.","path":["KRS Chapter 65"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39876","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:23Z","sha256":"871c62fa805a54bfacf49b3e77cc7662909929eb179f4702813422b655b9145d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-65.8903","next":"us-ky/krs-65.8907"},"notice":"GroundRules: Original legal text.
